I bought a pair of used shoes that looked very good in the photos and were described as VGC and ‘good’ but they had half worn out soles and one scuffed toe which were not shown on the photos. It was a ‘no refund’ purchase. As this was misrepresentation I raised a refund request for misrepresentation with the seller but they responded as if it was a non- delivery complaint, provided proof of delivery and the complaint was closed by eBay. I was then sent in a continuous circle by eBay in trying to reopen a complaint and could find no way forward. How do I resolve this?

You need to open a return case.
The seller could only have closed an 'item not received' case by proving delivery so you need to start a return stating the item was 'not as described'.

OK, it looks like you opened the wrong case, the good news is you can open a not as described case after a not received one, do that now.
