Out of pocket due to courier damaging my goods.

Hi all,

I am new to selling on here.

 

I recently sold a vintage fireguard on here and it arrived damaged.

 

The buyer paid for postage and chose Yodel as the postal service.

eBay deemed that the buyer was due a full refund which I agreed to,

However upon me trying to claim compensation for my out of pocket expenses I was denied any recompense due to the fireguard being a restricted item.

I am now out of pocket and own a badly damaged fireguard.

 

Where do I stand on this

If you choose to use a   Courier it is a good idea to check before buying their services exactly what if anything you would get when something goes wrong.

 

A Fireguard being a restricted item seems a load of nonsense to me, but from what I have heard mkdt couriers do not take any responsibility for damage.

Read this list, it is surprising that that get any business, your fireguard might have been classed ascan Antique.

It is up to sellers (not buyers) to select correct postal service for item. 

Buying postage through ebay is cheap, but as you found limited compensation and restricted items.

You are better buying postage direct from carrier with adequate compensation level.

When you sell an item for delivery on eBay you are 100% responsible for refunding the buyer it arrives damaged.

 

You accepted this in the usr agreement. This is very clearly explained in eBay's money back guarantee policy, which sellers as well as buyers need to read.

 

The choice of delivery service, including any insurance required, is entirely in your hands. All carriers, from Royal Mail to the cheapest budget couriers publish details of items excuded from compensation for damage - unless you pay for a service which provides this, where offered. You don't have to buy your delivery service through eBay, or use the carriers they offer.

 

I'm sorry, but if you chose to use Yodel's service and didn't check their terms and conditions you have only yourself to blame if the item you sent wasn't covered for accidental damage.

Thankyou for your reply but I didn't choose the courier.

I find it very wrong that I now have damaged goods and I am out of pocket
due to no fault of my own.

You don't have to use ebay suggested carrier, 

As you are responsible for getting item safely to buyer, it is up to you to select appropriate one.

Are you signed up for Ebay's 'simple delivery' by any chance?

 

Edited. Having just checked the simple delivery guidance it promises seller's full protection against loss or damage.  That seems to be an extraordinary promise given courier restrictions,  which the article doesn't even mention. 

 

If you did use simple delivery you need to challenge ebay on this.

When you created the listing, you chose Yodel and then purchased the label through Ebay.  It may have defaulted to this service but it would have been in the details of the listing before you hit the final button to make your sale go live.

On the original listing, there are no postage choices, only Yodel 'store to door'.

Like many couriers, Yodel do not cover antiques.  This is why you are unable to claim compensation.

It was your responsibility to use a suitable courier for a fragile, old item or, preferably, sell it using cash on collection.

It is a hard and expensive lesson to learn.

Unless you use simple delivery the only person who chooses the courier is you, the seller.
