Item sold on another platform, seller has declined refund request

Bought an item of clothing on July 25 and then immediately requested cancellation as I found it cheaper on Ebay. Seller declines cancellation request and says they have just returned from a festival to see I had bought the item which they have sold on Vinted so it is no longer available. Asks me how to cancel it? I advise them to contact Ebay and have messaged twice and heard nothing back - now a week on. Going through the report process with Ebay it states the item may still arrive until August 3rd - I know it isn't coming because its sold - what can be done in this instance?

You will just have to wait until the day after the expected delivery date and then open a case for item not received.

 

The seller was foolish to decline the cancellation request as they only get one go.

Unless you can persuade the seller to cancel the sale and so trigger a refund.you will just have to wait until you can open an item not received case

Unfortunately the seller has already declined a cancellation request.  That boat has sailed.
