If an item is not described correctly all sellers must accept its return within 30 days of delivery. The buyer should start a "not as described" return within that time and if necessary escalate it to ebay after 3 working days.
If an item is described correctly but the buyer would still like to return it for a refund only business sellers are obliged to agree to that. Private sellers don't have to accept "change of mind" returns.

That's not fit for purpose so would come under the "not as described" heading,unless the seller made it clear in their description that it wasn't working properly. Click on "Return this item" on right of your order on your Purchases page and select "Doesn't match description" as the reason. Escalate it to ebay after 3 complete working days.

Theorectically the guarantee covers the state of the item on receipt. But in your scenario "who would know?". In practice you have 30 days to raise a "not as described" case.
