Scamed ebay will not help

Hi sold laptop 12.05 buyer received 16.05 according to tracking (royal mail) 

And claim he didnt receive opened dispute( not through ebay but hes bank insitution) after few days he changed claim for not as described!!!!! (Not receiving item apparenty!!!!l ) (scam all over the place)ebay held my funds 2 months!! I presented proof of postage (actually paper receipt from royal mail) 

Got email today that his financial insitiotion sided with him and ebay will not give me money back and I cant dispute as this didn't cover seller protection!!!!

I sold item 

Item delivered 

Got proof of postage 

Guy scamed me got cash and item 

What can I do ?????

If the buyer opened a payment dispute claiming the item was 'not as described' Ebay can't do anything. The dispute is dealt with by the buyer's payment provider and they make the decision.

The only time you are protected is if the buyer previously opened a 'not as described' case through Ebay and you either refunded them or the case was closed by Ebay in your favour.  

There is nothing you can do - hopefully, the buyer has been told to return the item to you.

When a buyer opens a payment dispute because the item they received doesn't match the listing, sellers will be asked to provide evidence to challenge the payment dispute, such as photographs showing the item's condition prior to shipment.

When determining whether to protect a seller, eBay will look for one of the following:

  • The seller issued a full refund to the buyer through eBay
  • The seller issued a refund to the buyer through eBay, but deducted an amount from the refund because the item was returned used or damaged (in accordance with our guidelines
  • An eBay Money Back Guarantee case of the same type for the same transaction that was already resolved with:
    • eBay determining that the seller met their obligations to the buyer, or
    • eBay issuing a full refund to the buyer

Not all payment providers insist that buyers return the item in order to get a refund.

You can communicate with the buyer and ask them to send the item back.

Because the law allows buyers to request a chargeback if they claim their item is not as described.

 

Potentially, a fraudulent chargeback would be agaiinst the law, but it hardly ever seems to happen and the onus would be on the seller to prove fraud. Which is famously difficult, becuse as eBay itself has pointed out they never see exactly what the seller sent or what the buyer received, and often can't tell who has the vald case.  

 

Where can I report this as ebay dont care

 

When a credit card chargeback is issued it's the card issuer and not eBay who is responsible.

 

This means that there is no-one else you can report it to.  Buyers now pay eBay, not the seller, so the chargeback is between eBay and PayPal. You are not even a party to the dispute. Unlike the buyer, who has a right of appeal to the financial ombudsman, eBay sellers have lost tjhis righ. They just have to accept eBay's decisons and repay eBay for any refund it makes. Sellers also have to pay eBay's admin fees for refunding the buyer.

 

eBay invited me to become a member of a group set up to consider the intoduction of managed payments. I pointed out to eBay - several times - that one result would be that sellers would lose their formar statutory rights in the case of chargebacks, whereas buyers would retain theirs. eBay never even replied to these concerns, so I left the group.

Purchase item on ebay open dispute in your bank have item and cash .....
