This buyer bought a pen in which I made it clear the ink was nearly finished, so 19 days later he wants to return it saying it does not close properly I asked for pictures and the cartridge is completely finished. He's used up all the ink. Wrong, so right?

If buyer opens a return case citing not as described then you will have to refund them,and send a prepaid return label, refunding within 3 days of getting the item back,despite the buyers excuses.

Yes......if you decline to refund when a case is opened, ebay can place a defect on your account and simply refund the buyer courtesy of your account for the most part and not ask them to return the pen.
When the case has closed in the buyers favour you can appeal the decision if you can provide the appeal case with proof the buyer lied. Appeal the outcome of a case as a seller | eBay
Be warned that most cases can go in a buyers favour.

If the buyer wants to return the pen because it won't close properly (a fault not mentioned in the listing), the fact that they have used up the ink in a cartridge that you described as nearly empty is not relevant.
