I purchased a Disney advent calendar ,I have had a refund, the contents bore no resemblance to the p,

I purchased a Disney Callander what arrived bore no resemblance to the picture, being appalling quality, not standing up and exuding a strong chemical smell this was a gross misrepresentation,I have had a refund but this product is available from multiple sellers and I feel that eBay has a duty of care to customers to remove it from sale

They cannot act on one case alone,  but  may well remove it if more peeps open cases like you did to receive refunds

Numerous cases is a red flag to eBay , then eBay may well place selling restrictions,  or see to the removal of said item.

You need to understand that eBay is simply an online market place where almost anyone can sell almost anything. eBay makes it clear in the user agreement that they do not check or scrutinise listings and that sellers are wholly responsible for what they offer for sale.

eBay even warns buyers that "they do not guarantee the existence, quality, safety or legality of items advertised, or the truth or accuracy of descriptions". You accepted these risks in the user agreement. Buying from unknown sellers on eBay is not like buying from the shops. eBay is a jungle.

If these calendars are poor quality and smell of chemicals they're probably fake anyway. eBay's advice in this situation is that you should report suspected counterfeits to Disney yourself; they won't act on reports from ordinary members - only if Disney itself reports it to eBay.
