Nope he cannot ' just take the money and go away'. You are fully protected under eBay's 30 day MBG, Money Back Guarantee if you put in a claim within 30 days of the item's last estimated date for delivery.
Using someone's photos is allowed, in my humble opinion a tad lazy to do so, and especially if it's a used item, then the item this buyer is selling may well not be exactly as the photos he's using.
If a reasonable time passes your item's last estimated date for delivery, and you have not received the item, then, if the seller is not being helpful, go right of the item purchased, and from More Actions select.... I Have Not Received My Item.
If you are not fully refunded within 3 days, you must escalate the case on day 4 or within 30 days from opening the case, and eBay will step in and force the refund.
Do not close the case early for any excuse or promise the seller may give, and do not forget to escalate.
Should you receive the item , a cucumber be it, or an item not as described proceed this way:
You then go right of the item in your Purchase History, and from More Actions select Return this item, selecting the reason... Item Does Not Match Description or Photos.
The seller has 3 days to accept the case, if they don't , you need to escalate on day 4, or within 30 days, and eBay will step in and force the refund.
If the seller wants the item back first, they need to pay for a fully tracked return postage. On receipt of their item they have 48 hours to refund you. Again, if they don't, you escalate the case.
Again, do not close the case early for any excuse or promise the seller may give, and do not forget to escalate.
