my French buyer is objecting to being charged vat on his purchase as I post from Spain but still list and sell on ebay UK

They will be charged because you are registered in UK.

Ebay can't cope with that sort of selling plan, it will always get the VAT wrong.

If your goods are in Spain you need a Spanish ebay account.
