I am expecting a dress back from a buyer they bought it in January ,it was brand new still with original tags never been worn it was my own dress .Any way a few days ago the buyer messaged me to say that they had washed the dress and tried it on but it doesn't fit and ebay have allowed her to return it the buyer said she has got the tags with the dress but she must have had to remove them to wash the dress as the tags are cardboard . So at the moment I am waiting for it ,but because I was concerned about the fact the buyer has washed the dress I contacted ebay about it before the dress was posted back and they said they would get back to me in 48 hours (which was up yesterday) ,and I have heard nothing back from ebay and the dress is due back today . Very dissapointed that no one from ebay has got back to me and you can't even get past the automated assistant to chat with a human anymore which is easiar than speaking on a phone as our phone signal is not always good and makes it hard to what is being said

You need to receive the dress back first before refunding. Then, if it has come back in a different condition you appeal the decision for the refund to eBay stating the buyer broke eBay rules by sending an item back washed with tags removed therefore, not in same condition as sent out, and now not saleable.
Guide them to the message that the buyer sent stating she washed the item, now it won't fit, could well have shrunk in the wash !
Contact eBay very first thing when the lines first open at 8 a.m. as there's more chance of Dublin answering.

As said I recommend contacting CS very first thing in the morning, when the lines first open, as there's more chance of Dublin answering.

Whatever response you get from ebay, when returned you get 3 days to refund.
Failure to refund, and if buyer escalates, ebay will refund at your expense and you get a damaging defect. In the days of fees they would not have been refunded.
After refunding then you appeal to ebay, but do not expect too much. The system is all automated and weighed in favour of buyers.
Even if you spoke to an agent, whatever they tell you is unlikely to change anything.

Dress has arrived back was shoved in a small grey mailing sack ,I sent it in a box to protect it .The wash has made the care /wash label curl up and the button holes where the shoulder straps are are fraying on the edges . I have explained the situation to ebay and they said they will look into it but I won't hold my breath .

Take photo's of the damage on the dress etc so you can appeal the return case within 30 days of the case having closed, see this link about appealing Appeal the outcome of a case as a seller | eBay

Ebays policy's say that Item should be returned with the same packaging it was sent in I sent it in a box and it has come back shoved in a small grey mailing bag ,it was a brand new dress never been worn it was my own dress so i knew it had never been worn but the buyer told me she washed it ! so I wonder why she did that which I see has caused damage to the dress so I can no longer claim it is new . As to ebay and their handling damaged returns ,after seeing the film on youtube about the couple who had a terrible time with a damaged car light that was sent out new and the buyer saying how pleased he was with it,but the buyers mechanic damaged it fitting it ,cracked it and the buyer claimed it was faulty and ebay made the sellers jump through hoops to get proof the light was damaged even getting them to go to the police several times and still ebay refunded the buyer .The sellers filmed themselves opening the box the light came back in too and showed the damage . So I don't hold any hope of ebay listening to me

Sadly some buyers buy clothes,wear them then wash them and send them back,so what ever a sellers sells there is always going to a be a risk involved.
Ebay have there hands tied,as they neither physically see or hear either sides of what has really happened, so all you can do is try and appeal.
