item not arrived

Hello all hope your well. I'm really new to ebay. I ordered an item, and due to work commitments being out the country, the item got sent back to the sender.

After asking the seller to please check the status of the order, to no avail, raising the issue through eBay managed to get a response. The tracking literally says in black and white that the item was returned, on the 13/12, yet the seller is denying all knowledge of it.

I'm struggling to contact ebay directly, I'm just unsure and a little bit disappointed something like this can happen. It seems a straight forward issue resolve seeing as it is on eBays system.

Any help would be extremely appreciated.

Kind regards

eBay's policy is (or was) that attempted delivery is treated as successful delivery. If this policy still continues, eBay would not require the seller to refund you.

The reason for this uncertainty is that eBay has changed its clear, full money back guarantee policy to a simplified "user friendly version for online use". It is almost impossible to read this Noddy version because you keep having to click on one link after another. I have even tried to copy the html and extract the contents as text, but it ddn't work.

I suspect that mention of this particular policy was quietly dropped in the new version. But can anyone please correct me if I'm wrong.

p.s. depending upon how you paid, you may get more help from PayPal or you card issuer. Unlike eBay, PayPal requires proof that an item was succssfully delivered, not just that delivery was attempted. So does the law, but eBay only enforces its own user agreement, not the law.

Oh wow. I'm actually shocked by this. So the buyers protection thing on my purchase counts for nothing then?

Ebays tracking system literally says I have not received the item. Yet they still class that as successful? That is really really poor from them.

Thankyou for your reply however it is much appreciated

Ebays tracking system literally says I have not received the item.

You originally stated that "The tracking literally says in black and white that the item was returned".

When an item is tracked as returned this usually means that delivery had been attempted.

If the tracking states that it was not delivered you may still be able to use eBay's money back guarantee. The exact wording may be important. Provided you're still within the 30 day time limit (in this case, from the latest estimated delivery date).
