Item sent to wrong address

I have purchased an item and the seller decided to have it sent to a pick up point (UPS) without consulting me rather than the my home address that was clearly stated on the order.  I am unable to get to the pick up point and advised the seller of this.  He says he will cancel the shipping with UPS and ship again to the correct address but NOT until UPS refund him for the shipping on the incorrect shipment even though it is his error not mine.  I have no bearing on how long UPS will take to refund him but that should not be my concern - I just want the order delivered to the correct address.

He is now not responding.

This item has not been collected by UPS so in effect he has not sent it yet but I cannot see a link to cancel order.

Can anybody help me with this?

Thanks vyolla.  My response about not being able to open an item not received case at this stage was to john1297567 - but in any case the seller decided to cancel my order and refund me as he did not wish to "incur repeat shipping cost" for sending me the item to the correct address!!.  Not the solution or experience I had hoped for.  First time this has happened in over 20 years on eBay.

The seller must send the item to the delivery address showing on the order details, this is the one that the buyer has selected.

 

If your seller hasn't done this, then one day after the latest estimated delivery date showing on the order you can open an eBay item not received claim and escalate it within 3 business days to get a refund.

Hello

Thank you for the reply.  This makes sense.  I can confirm that the delivery address on the order is my home address and is exactly where I expect it to be delivered to.  The seller says it is 'better for me'  for him to ship to a UPS access point for me to collect.  It isn't and was never discussed or an option 🙂

Yes but the problem is that they are not responding now and the 'Cancel Order' link is now not available or I would cancel the order as it has not yet been sent (just the tracking number has been generated - but UPS have not collected the parcel).

You cannot cancel, but if you let seller cancel, it lets him off the hook for inventing the delivery address.

 

Just open a not received case, if seller then gives a tracking number you will have to explain to ebay that proof of delivery is not to your address.

Seller must learn that he must follow buyers instructions, and not make up his own rules.

Sadly it seems that I cannot open an item not received case until after the due date of delivery, which is 15th May.  I assume that this is because the seller has given a tracking number so eBay assumes it is on its way.  It isn't as the seller has been told under no circumstances to send it to any other address other than the one on my order but is choosing to ignore.

Yes, as I mentioned in my earlier post you have to wait one day after the estimated delivery date, it doesn't matter if a seller has tracking or not, this is how eBay works. There's an estimated delivery date showing on the order and a buyer can't claim not received until that date has passed.

 

When you open that claim I'd also contact eBay to ask them to check the tracking number because it's not your delivery address.
