If I am covered by “ Money Back Guarantee “ why have I been refused a refund for a recent purchase?
It was a bench that you assemble yourself.
After not receiving the bench on the promised date, although the seller informed me that a delivery was attempted and failed, which is a lie as the carriers sent me an email saying that this delivery was delayed and trying to change the delivery address and then arguing the toss with not only the seller but with eBay who were more biased to the seller have I now been refused a refund altogether.
I can’t see what the problem is just to get a refund. I tried and failed to cancel this order. I was getting so fed up with the arguing and protests, I ordered another bench from elsewhere and got it in three days. When I eventually got the bench that I tried to cancel repeatedly, getting ignored by the seller, it took nine days. I even had to give the delivery driver £20 to take it to the changed address.

There are a few issues that you need to explain a bit further in order for helpers to understand your situation.
What does the tracking say about the attempted delivery?
And you also mention a change of address. Can you explain what has happened?

Only you know which bit of the money back guarantee you didn't meet, was it time limits, the type of case you opened, or something else?

I’ve just sent a message back but just in case you didn’t receive it , here goes again.
you asked about the tracking of the failed delivery. It never took place, the carrier sent me a message to say that the delivery was delayed after a few days. In the mean time I thought that they failed to deliver to me so I sent them a message asking if I could change the delivery address so they could deliver the next day. I didn’t know about the delay because I hadn’t received any message then.
Why the seller is lying about a delivery that never took place is beyond me, the last communication I got about this was either from eBay or the seller I can’t remember which but it was stated that an attempt was made, I was never informed about this nor sent anything to say this.
If the seller had followed the rules set out by eBay in the first place none of this would be happening. As far as the bench is concerned I won’t be asking for a refund anymore as I have sold it privately at a loss of £17 just to get rid of it.

If the tracking record stated that delivery had been attempted, this explains why your "Item not received" case failed.
eBay treats attempted delivery as being successfully delivered. Absurd as this may be, and a contradiction in terms, this policy is stated in the T&C for buyer protection and you accepted it in the user agreement.
It's a pity you didn't claim through PayPal. PayPal requires sellers to prove actual delivery, not just that it was attempted. As does the law for deliveries by UK business sellers.
