eBay just say send it back to the seller when I already know it’s not there fault
That advice is incorrect in every way.
If the item is not in the condition described, which would include the original box if part of the sale, you need to open a case under eBay's money back guarantee. Be careful to describe the problem as damaged in delivery.
When sent using eBay's global shipping the seller is responsible for refunding the buyer if they did not desribe the item correctly. But as regards damage in transit, they are only responsible for damage occurring during delivery to eBay's shipping hub. If it was safely received at the hub but later damaged after repacking and shipping abroad, eBay and not the seller is responsible.
eBay should provide a prepaid return label, and refund you in full. The item then becomes eBay's property and the seller keeps your original payment. eBay eventually disposes of refunded items, presumably throught trade disposal auctions. (To save you asking, eBay won't discuss requests from buyers to buy individual items back.)
