seller asked me custom fee which is £50

this seller didn’t inform me about this 

I opened return case but i don’t even have this item because it us still in custom 

I need to refund my money back

YOU are the importer  so it is up to you, not seller, to know that import fees have to paid.

Seller does not collect these, ebay and carrier do on behalf of HMRC. 

By refusing to pay import fees, you invalidate ebay MBG, so will lose item and money.

The customs fee is not the seller's responsibility - if you buy an item from overseas, you need to do your research in advance.

You should check the terms of the Ebay Money Back Guarantee.

If you don't pay the fees and accept delivery of the item, you are not covered.  Clearly you can't return an item you don't have.

I am not sure how you will go about getting a refund.
