Hi all,
I purchased a wheelbarrow wheel in August, and last week (17/10/24) the wheel bearing collapsed. I messaged the seller and enclosed some photos of the wheel in its current state and was awaiting a reply in regards to a resolution to the item. After a couple of days, I didn't get a reply so I decided to open up a case. I tried to raise a case via eBay but couldn't as I purchased the item more than 30 days ago?? ( I didn't get the option to say that my item has become defective after just over a month of use ). I went down the PayPal route but again, didn't get the option about reporting the item as faulty or defective. My only option was to try and return the item and get a refund via "not as described" I enclosed photos in my case submission and explained everything. After a day, PayPal decided in the seller's favour and now feel out of pocket. My ideal resolution would be to get either a new wheel or a bearing sent out to me via the seller. Yesterday (22/10/24), I got a message from the seller saying that they have seen my message and asked me If I would like a replacement wheel to be sent out to me?. I replied yes and they said they would If I closed the case via the resolution centre on eBay. I tried looking for the resolution option on eBay but couldn't find anything in regards to this case. The autobot service didn't find anything either. The seller was very firm that they would not dispatch the replacement item till the case is closed even though there is no case. Could anyone advise me on what to do please?.

Tell the seller that even if there was a case on ebay it's too late to be of any use and would expire eventually anyway.

Both eBay and PayPal provide a 30 day Money Back Guarantee for items that are not as described when delivered. Neither are intended as a warranty. Any warantees are between you and the seller.
Once a PayPal dispute is opened any dispute on eBay is automatically closed, as you cannot have 2 disputes open for the same item at the same time, so no idea what the seller is talking about there. The PayPal dispute failed because it was more than 30 days since the date of delivery.
If you funded the purchase with a debit or credit card then you have 120 days from date of purchase to file a chargeback with your card issuer.

I'll have to be careful from now on when making purchases from eBay as I feel that there's no statutory rights for a consumer purchasing a brand new item. I am basically out of pocket on an item that is over a month old and at the seller's mercy on a replacement which now looks as if they don't technically have to do so. I didn't purchase this using a credit card. A lesson learnt.

You still have statutory rights but they have to be pursued through legal channels. Speak to Citizens Advice or a solicitor.
EBay's and PayPal's Money Back Guarantees and Chargebacks are all provided in addition to your statutory rights. Each has its own terms and timeframes.
