It's not fair dinkum. There is a New York law firm that specialises in image theft and, reportedly, typically win $12,000 for their claimants. You can find them on Google. They take a large chunk but the cases are very easy to prove. However eBay licenses images to businesses but you have to opt in and then you can use the images of others. It's for new products.

this is e bay uk not new york or big american corporations get into the real world for a minute...
if you have bought the item with the intention of reselling it whats the point of duplicating the pictures
whats the difference in photographing a item of 2nd hand tat whether its on your carpet or the sellers carpet the photographs will be exactly the same.
now if they were used to sell a simalar item (which is just lazy and a INAD) decieve someone into believing that is whats for sale but isnt (deception against e bay rules ) or to scam get nothing at all thats a totally different matter it then becomes a crimminal offence.
but the o/p didnt state which one.
most e bayers are just glad to sell the item and dont kick up a fuss about such a trivial matter after the sale .

then thats fair dinkum as the aussies would say on the other hand if they have used your photos being lazy and not taking their own then its not as described.
you,ll find plenty on here they,re called freeloaders...{;0)
You may call them freeloaders, I call them lazy.
It's just pure laziness not to set up your items to be photographed, and also leading yourself to returns for items not as described.
Photos are as important as any description, and a second hand item cannot possibly be identical to another. Any sharp eyed buyer seeing a difference, and a correctly return for item not as described would be opened.
So lazy and careless on behalf of those sellers. Careless enough to possibly receive defects leading to selling restrictions.

Yep, sorry, reselling an item received, so the same item, and yes carpet is not for sale, I too personally, do not find that a problem.
It happened to me a few times when I was selling , buying an item from me, selling it on for more, and using my photos..... well I said OK well done. 🙂

Nope I did not sell the item here in the end. The person used my pictures and made the sale while my item was still for sale lol.

I did not mark this as a solution assuming mod did. Apologies to anyone who I offended yesterday apparently someone was upset. I was just annoyed that someone used my items images, while my item was for sale here and made a sale themselves. While mine was still sat there ha ha. It sold to a friend now anyway so all good. 😊

This I believe would be kind of ok. Maybe not though as item condition could have changed. But in this case the cheeky guy sold his item using my images while my item was still for sale. Undercutting by some margins too lol 😂

Mentioning my carpet was just a joke.. Basically why would anyone want to sell an item using my bad pictures and carpet as backdrop. Then again he did make the sale on here where as I did not so… Lol 😩🤣 funny times.

This, photos are even more important than description. Description are Ai now? And subjective. A photo or video proves the item is what it is. Nail hit head. Thank you. This is the solution…

I wish I could change the title to “ Someone used my live listing image to make a sale “.. lol
