Buyer refused package now what

Hello!!

I'm in a right Pickle!!!

 

Buyer purchased a few items from me I'm sent them in a cardboard box perfectly packaged and sent via evri. 

Buyer had messaged complaining delivery was taking too long (it was the 3rd day of dispatch).

I explained to please allow that it's the weekend and bank holiday but it should be there very soon.

The buyer has just messaged me in broken English that she has refused my package that it was very damaged. 

She sent a screenshot of the tracker that showing someone holding the box. The box is crushed in the corner put not ripped. 

I asked her if she had opened it to check if the items are intact. She said she didn't get that far she told the courier she doesn't want it. 

I said he shouldn't have done that, she should have accepted to check what's damaged. If there are damaged items then you open up a case with ebay and I will refund or replace. She basically said no the courier will send it back. I explained that almost never happens and it covers both our backs doing exactly what I've just said. 

I've advised her she needs to now open a case because I don't know what else to do 😕 

She saying no she wants a refund.

 

Can somebody help! I just don't know what to do. That's a lot of money I'm going to lose if the courier doesn't send it back. I tried saying to the buyer that nobody has paid for its return so its just going to be sat there in the depot.

 

Surely this is grossly unfair if this goes in her favour.

Please don't refuse delivery, I have done that and it caused me all sorts of issues. Accept the item and contact eBay asking for refund as item different from description. Then you will get your refund .

It doesn't sound like the item isn't as described. The poster guessed a measurement that wasn't provided in the listing - as that information was important to them they should really have asked the seller for that information prior to purchasing.

 

If the seller is a business seller they are obliged to accept remorse returns. Although the poster will almost certainly have to return at their own cost they would be refunded the full purchase price and any outgoing shipping charge. If the poster opens an INAD dispute and the item is as described they will likely be reported by the seller for abusing the MBG process. If the seller does this and eBay agrees with the seller's report they may remove the poster's ability to use the MBG in future.

 

It still isn't clear if the poster has actually opened a dispute via PayPal or not.

Give me ambiguity or give me something else.

Well spotted; I see it now. As the seller is a business the poster does have a right to cancel but as per the seller "Buyer pays return postage".

Give me ambiguity or give me something else.

I haven't opened a dispute. 

The seller has now messaged me telling me to refuse the delivery and they will refund me. As he's messaged it in eBay I am assuming that even if I lose my buyer protection I would be able to get the refund if he doesn't send it?

Given that you have already received the item in question you're not in a position to refuse delivery.  Even if the item had not arrived it would be very stupid to accept delivery, as by refusing delivery of the item you would invalidate your buyer protection under the eBay Money Back Guarantee.  The seller was more than likely aware of this, hoping that the item hadn't arrived and that by duping you into refusing delivery you would then inadvertently void your eBay buyer protection.

 

Clearly the seller cannot be trusted, so this one is more than likely going to be a bit of a difficult one to resolve.  First of all reply to the seller's e-mail, stating that you've already received the item but that you would like a refund.  Given that the seller is a business seller he/she is obliged to accept returns, including remorse returns, although in your instance you would have to pay the return postage costs yourself given that it is a change of mind return, which counts as a remorse return.

 

Unless there is something about the item that contradicts what the seller said about it in the item description in the listing, or if there is damage to the item that the seller failed to mention, you cannot justify opening an eBay case for Item Not As Described.  As has been mentioned elsewhere in this thread, if you were to open a case on that basis when there is nothing wrong with the item then the seller could potentially report you to eBay for doing so, and if he/she did so and eBay sided with the seller you could end up with your rights to use the eBay Money Back Guarantee being restricted in future, even if you subsequently had a case where you could truthfully say that the item wasn't as described.

 

In view of the above open an eBay case, stating in the case that you have changed your mind and wish to return the item.  You would have to pay the return postage costs yourself given that it is a remorse return, but the seller should still accept the return and refund your money.  If he/she doesn't then that's when you should escalate the case to eBay for them to make a final decision upon, although you would need to wait until four working days have passed from the date that you opened the case.  Should you need to escalate the case to eBay then they would force through a total refund of the money that you paid to the seller.

I haven't received it yet. Asked for it to be cancelled on Saturday was ignored and told it was too late as it was dispatched at lunchtime today. I've seen that refusing delivery voids my rights but surely if I have an eBay message telling me to do that and promising a refund then it would have to be honoured,?

If you refuse the delivery and the seller doesn't refund on return then you won't be able to enforce the refund through eBay.  In theory as you have written evidence that a refund has been promised you would be able to file a chargeback with your card issuer for the reason 'Refund not received' or possibly through PayPal.

 

However, it is generally a lot safer to accept delivery and then return either as a 'Change of mind' or as an 'Item not as described'. 

 

An 'Item not as described' return can relate to the service received as well as the condition of the goods so, I think, would be justified in this instance as the seller should have accepted your cancellation request, in line with their legal obligations, and not proceeded to despatch the item.   You, therefore, did not receive the service you were entitled to.
