I won a listing and paid for it. The listing consisted of 3 items. A large double heavy track controller, x2 trains and track. The trains arrived smashed as the items where just wrapped in loose wrapping and put in a large box and all had been rolling and clattering around in the box getting damaged. The trains arrived smashed to pieces. I contacted the seller sent photos explained what had happened and how. The seller doesn't offer returns but accepted to do a partial refund on the trains as I wanted to keep the controller. After 3 days of messaging, the seller confirming they had sent a refund and myself opening a return process I still have had no notification of a refund from ebay but the seller is saying they have and its down to ebay to sort? can anyone help?

If a refund has been issued you would have received email notification from ebay, even if the money is delayed. You could contact ebay and ask them to check. You can use callback on here:

If there's no partial refund you should escalate your case after 3 working days and before 30 days to return the goods for a full refund. That's the only thing ebay can enforce.

Just to add if you do go for a full refund which you are entitled to when receiving a broken / damaged item and claiming within the given period of 30 days, then all the items have to be sent back , if the seller sends a pre paid label, you will not be able to keep the controller.
If the partial refund is fair, and reflects the refunding of the 2 trains being damaged and you get to keep the controller, this is the way to go.
Be aware though, there's nothing to enforce a partial refund if one is offered, eBay will send you a message, that this is in process. If nothing is forthcoming from eBay no partial is on its way, do not time yourself out then, for a full refund, on the return of All the items.

The seller can only send you a full refund now you have opened an eBay case, so you will have to return all the item for a full refund

Given that you have opened an eBay case the seller, as explained previously, can only issue you with a full refund now, as opposed to a partial refund, especially if he or she issues you with an eBay Returns Label and asks you to return everything first in order to receive your refund.
In the event that the seller starts playing Silly Buggers and refuses to issue the refund, resulting in you having to escalate the case to eBay in order to receive a total refund, eBay would not require you to send the items back to the seller before the refund could be issued. If eBay had to force a refund you would get to keep everything that the seller had sent you, regardless of whether it is damaged or not.

I have never heard of ebay actioning a partial refund on behalf of a seller. Please let us know if it happens.
