I bought a smartphone with sellers 3 months warranty. Within 2 months it was faulty, seller sent a returns label. Phone returned with proof of posting. He occasionally replies to emails saying I was to be reimbursed in full but it never happens. Mistakenly I trusted him and now it is too late for eBay to intervene. This has now been dragging on for 3 months, no phone & no money but plenty of empty promises. Reported to eBay as fraudulent seller who say they will investigate . Bought with debit card so bank can’t recover costs from eBay only seller

I don’t understand your last sentence. Banks always go after ebay in a chargeback situation, then ebay gets it from the seller.
You were already out of time for an ebay claim, that period is only for 30 days after delivery.

It sounds entirely probable that your seller is attempting to time you out by stringing you along until you can no longer make a chargeback via your payment provider.
If you have online banking then simply log in to your bank account, find the original transacton entry, and look for the chargeback option/button/link.
Your bank will usually require you to prepare a short, concise statement regarding the transaction and failure of the seller to provide a refund despite the return within warranty i.e. what happened and still no recompense.
Screenshots of the original purchase here or other receipt, the proof of posting, tracking page which proves delivery, the promise in writing by the vendor to refund, etc., can be uploaded to the claim.
Should you not have access to online banking or encounter any difficulties then do contact your bank ASAP, either in person at your branch or online chat, and do use your browser by typing in the name of your bank followed by "chargebacks" and read the information on an official page... forewarned is forearmed.
Do not delay any further, and good luck in your endeavours.

@steele5822 I meant to add, to my earlier response, that if you payed via PayPal then the refund/chargeback process is very similar to the one I mentioned with regards to your bank.

Unfortunately PayPal now also only provide a 30 day window for 'item not as described' claims. INRs are still 180 days.
