Neither eBay and nor PayPal will activate any guarantees and refund

long story short bought a shed via eBay, paid via PayPal credit, shed arrived, by time managed to start building it, found was faulty, engaged with seller directly to and fro'ing. Didn't get eBay or PayPal involved till past their 30 day protection windows, managed to get seller to accept return of shed, with proof of delivery back to them. Seller won't refund or answer messages now.

 

Neither eBay and nor PayPal will activate any guarantees and refund, despite proof of return and no payment to myself, due to not letting them know in the 30 days.

 

I've escalated to a Section 75 with PayPal credit and they are now saying;

 

"Following a thorough review of the transaction and all of the relevant information provided, we have concluded that the evidence you have provided does not substantiate a valid claim under the Section 75 of the Consumer Credit Act 1974 as there is no no debtor - creditor - supplier relationship."

 

I don't understand how this is correct, reading between the lines are they saying that I am missing sending them something like a screen shot from PayPal as obviously you assume they can see those things. Is it that the burden of proof is on me they can defend by being so petty?

Paypal Credit or Paypal Pay-in-3?

 

Bear in mind some of the nonsense that comes out of their mouth (lets just say currently have an ombudsman case, though nothing to do with a chargeback) is unbelievable for a regulated outfit. It is interesting that they appear  to be suggesting that eBay-as-middleman invalidates your rights, funny how that's helpful when it suits eh? Shame we can't use that against eBay when WE get chargebacks as sellers which oh so conveniently become our problem to deal with especially as private sellers.

Hi,

 

It's PayPal credit, which I assumed was regulated under FCA, I can't believe that neither eBay or PayPal would help with money back guarantees as I didn't do anything within 30 days. I thought their usually advice was try and sort with seller first, which I've provided evidence that I was messaging them and it took an eternity for them to arrange the return (they kept changing their minds).

 

I know sometimes that if you use PayPal and a credit card that can sometimes invalidate or make a section 75 claim more difficult due to debtor creditor supplier, but I've never come across PayPal Credit being used on eBay that also invalidates this?

 

From their response they say that, from the evidence supplied about the debtor creditor supplier bit, so I'm wondering if they are being awkward and I have missed supplying something, going on the fact that PayPal Credit and PayPal being the same company, and have access to everything, but given it is me that is making a claim the burden of proof would be on me etc...

 

I've asked for clarification about why there is no debtor creditor supplier relationship, merely to be told that the legal team have reached a decision and offer no justification for this being the case.

 

I suppose my next step is to make a formal complaint at PayPal and then take it up with either the FCA or ombudsman.

 

It's absolutely ridiculous though as I've messages showing the return labels supplied from vendor, and then proof of delivery with tracking on the return they provided.

 

So the vendor has received the item back, ceased communication and now PayPal Credit are saying Section 75 doesn't apply either because I've missed sending them something which they won't tell me. Otherwise they are saying Section 75 doesn't apply when using PayPal Credit on eBay (but this conflicts with what I've read online).

This reads like a job for the small claims court, send the a letter before action (the shed supplier).

You can find a good template online.

Because its outside the 30 day a bit of a hassle as you just want an easy remedy.

I don't think there is an easy remedy because the supplier is not playing ball.

Hi,

 

Yeah the only problem with small claims court as it's a Chinese company obviously with some storage in the UK, not sure if they have anything other than a warehouse over here.
