Around about one in three purchase transactions I make with EBay are fraudulent. EBay very carefully ensure that their sellers are completely protected and if you try and complain you are mischievously restricted to getting a refund when I really do not want a refund as the process is designed to ensure you fail to get dealt with.
Ebay have descended into this racketeering and I sincerely suggest that you now shop elsewhere. They are a filthy scandalous operation that gives impunity to every last seller that pays them a commission. Even when I finally managed to get a call back, I picked up my phone immediately and EBay immediately out the phone down within less than two actual rings of my phone bell. This is not an accident. This is what they have descended to and hopefully they will feel the power of a rightfully angered ever growing assembly if buyers who do not wish to assist ~eBay’s filthy racketeering, because that is exactly what it has now descended to.
Instead of bothering to get myself humiliated by attempting to get some assistance, which is futile and is obviously meant to get rid of justifiably outraged buyers I have found it less stressful to throw the garbage I keep getting in place of what I have paid for, into my trash dumpsters where it belongs and simply walk away because I am a 73 year old cancer patient who is both disabled and terminally ill and with very little time left on this planet, (thank God,) it is less stressful to accept that EBay has once again turned a blind idea to me being mugged every week than to find myself treated like vermin by EBay and it’s thieving con artists who appear to be the backbone of their merciless profiteering.
I have no power to do anything but lose the money I gave paid every time EBay protects another one of its protected thieves and fraudsters. I am used to being targeted by both ruthless politicians, being a pensioner living alone facing my up and coming death in a cottage that is very deep in the Scottish countryside. As it is, I am targeted by an evil government that is stealing my pension and this means I have to spend what is likely to be my very last Christmas freezing and alone, partly due to EBay constantly allowing liars, false advertisers and con artists to trade with impunity.
This is now happening so often that I cannot help but suggest that if you, too, are suffering from EBay’s disgraceful profiteering that flies in the face of The Act of Misrepresentation, 1967, that yiu break the habit of purchasing anything here not that EBay has the slightest idea of what that act stands for and nor is it the slightest bit interested in respecting that act nor any other laws. Treating The Act of Misrepresentation with unreserved contempt, which I am used to expecting in the Third World where honesty has very little value, is exactly what I get all the time from both EBay itself and from it’s filthy pit of small time criminal vendors.
You have been warned. Trying to pas the evidence to EBay will enrage them. That is all you will get from them. Write yiur losses if and get the hell away from this sick and ruthless company.

your feedback left does not support what you say and eBay can only enforce refunds, not replacements.
Buyer protection on eBay [eBay case / PayPal case / chargeback] is the best you can get.

If you get the wrong item, you have the option of returning it for a refund.
From your post, and the negative feedback you left, you choose not to use the Ebay Money Back Guarantee and the returns process.
That is your choice.
However, stating that Ebay ensure that their sellers are protected is just not true.
if you open a return for an item which does not match the listing, the seller has to pay for a tracked return before fully refunding you the cost of the item and the postage you paid.
That is a good deal for the buyer and a loss for the seller.
If you are frequently unhappy with your purchases, open a case, send the item back, get your refund and leave brief negative feedback.
Those are effective strategies. Ranting about Ebay is not.

You are not communicating with anyone from ebay on these boards.
The people who have responded, like me, are just other members like you. They are not our customer service reps and they are not our sellers.
Who is it you are planning to sue, and for what exactly?

Your “over 25 years of global litigation - -” will not help you when you sue me -
“I still share an accountant in The City of London who can and will instruct any chambers in this country that I ask him to contact. One of my privileges is that I receive service in these matters on a complimentary basis due to the enormous amount of business that I have done within the legal profession so if you want to treat with me before I avail myself of the remedy then I suggest you get a grown up to contact me.”
If you cannot even understand the workings of the boards you are publishing on you have no chance, no matter how esteemed your legal representatives are.
