Counterfeit item purchased and refund declined, Help required

I have bought an item which was advertised as legit, however upon receipt of the item. The sizing is way off, and on inspection the item is not legitimate. I selected to return under 'Item doesnt fit' which I believe now I should of put not as described.

The sellers declined to refund, and the case is now closed and I can not appeal. I have tried getting through to ebay, but the live chat just says the case is closed and can not assist.

 

Any advice welcome on how I can proceed on this matter, as can not see any email or phone to reach out to them on.

I am afraid you just get one chance at an ebay returns, you have used that up.

If you paid by a credit card through ebay i think you can charge back through the

credit card company stating the item is a counterfeit.

You can try speaking to them but they don't usually make exceptions to the rules as it would mean chaos.

Given that you have already opened an eBay case against the seller in relation to this item and it has been closed in the seller's favour you will not be able to open another eBay case in relation to the same item.  However, if you used PayPal to pay for the item and it has been less than thirty days since you paid for it, try logging into your PayPal account and open a case against the seller there, stating that the item is not as described.  You could also add details to the case stating that you believe the item to be a counterfeit in order to further strengthen your case against the seller.  PayPal tend to look at cases far more closely than eBay do, although you should bear in mind that if you do open a PayPal case then if it becomes necessary to escalate the case in order to get your money back then you will need to do so before PayPal's twenty day cut-off date.  If you leave it longer than this the PayPal case will automatically time out.

 

In the event that you didn't use PayPal to pay for the item and instead paid using a credit or debit card then I would advise you to contact your card provider and start a chargeback.  You have a maximum of one hundred and twenty days from the date of purchase during which to do so, so you should stil have a decent chance of securing a refund , despite the fact that you chose the wrong reason when you opened the eBay case, the end result being that the case went against you.

 

Finally, if at any point in the future you purchase something on eBay and the goods you receive do not match what was described in the listing then the reason you need to give when opening the case is that the item does not match the description.  By opening an Item Not As Described case you are far more likely to win the case than you would be if you gave the reason "Item Doesn't Fit" - or, for that matter "I've Changed My Mind" - as the reason for wishing to return the item for a refund.  Neither of these descriptions will help you to win a case where the item isn't as described in the listing, and will more than likely result in eBay closing the case in the seller's favour.
