If you have gone over the period to claim for a full refund, that is, more than 30 days have lapsed from your item's last estimated date for delivery, then yes, the case will have timed out and closed.
The seller played you with excuses and promises and you went over the deadline to claim. Never listen to a seller who is dragging out a reason for a refund, there is no reason, they should refund, if they don't , you escalate on day 4 for a full refund.
