Hi all i sold an item, through ebay its a unused item but old stock (my late father left all his stock, in 2006, all new but old stock), i sold the item on april 23rd 2021, all was good, but yesterday i had a ebay message from the buyer saying the item had packed up and he had to purchase a replacement, i replied to this telling him there is not a lot i can do at this time but for him to contact ebay and we go through the correct channels. The next message i get from the buyer is "i purchased this item from you not ebay so you sort it", i replied again telling him look i cannot refund on his say so i have to see the supposed faulty item before i can issue a refund. within minutes i get this message from the buyer: -------------------------------------------------------------------------------------------------------------------- Okay I'll cut to the chase, please refund me within 7 days. Let me know if you want the pump sending back. If you don't I'll be obliged to send you a "deadlock letter before action" via recorded post. If you ignore this I'll open a small claims court. Takes all of 5 minutes and you'll end up paying court fees. I've won every single court case I've opened (30 odd). Ball is in your court. --------------------------------------------------------------------------------------------------------------------- I am not a business seller all the items i have are from my late fathers stock which my mother wanted skipped, i asked if i could have then and she agreed as long as i remove them all, to which i did and took photos etc and listed them all as new but old stock. I contacted ebay for some advice and they said it was nothing to do with them and for me to work with the buyer to sort it, but the buyer is adament he wants money back or court, the item was £24.99. do i just pay him and leave it there or do i challenge him and await the deadlock letter and court proceedings?? i have offered the refund if he sends me the supposed faulty item, by the way the item is a car part that had to be fitted in a fuel tank and had to be lubricated to keep working in other words always had to have fuel and clean fuel to run.
