Hi, I purchased an iphone for 750 on 11th Dec and made the payment within 10 minutes of winning the auction. The seller had no negative reviews and was communicating well with regards to postage (prior to winning the auction). 30 minutes after I made the payment via PayPal he cancelled the order and when questions why, he told me he sold it to someone else for much more and has just posted it to the other person. I was very upset since my payment had already gone thru but in an attempt to stop it I contacted PayPal to make them aware that I'm disputing the payment. I then reported the seller to Ebay for violating their rules and tried to open a case with Ebay but as he still had till 20th December to post it I was unable to do so. The seller has repeatedly contacted me that I have to cancel the order as well otherwise I won't get my money back. I didn't do this because I wanted him to be liable for the selling fees. I waited till 20th December to progress the case via Ebay but wasn't given the option so I progressed it via PayPal. I had to wait till 30th Dec for Paypal to look at the case as the seller was given till then to respond. On 31st Dec Paypal processed my refund and within a few days I got my money back into my account. The seller has now (13th Jan) contacted me again: "Hello, it has been many weeks now, I have agreed to cancel on all the cases and all forms of contact and you still have not, I wont be able to send your money back if you do not agree" My question is, does the seller still have the money?? Did PayPal refund the money out of their pocket and the seller gets to keep the money if I don't cancel?
