I opened a return case with seller as not as described and he has told ebay he's sent a return label but hasn't I have requested several times and now he offered a partial refund but said I need to close the case, which I'm not going to do, I can't escalate the case to ebay as the option isn't there even though it's more than 3 business days, not sure what to do now

Did you raise the case officially with ebay? Or have you just been speaking tonthe seller

This is how the MBG works.
If you open a not as described claim seller has 3 working days to respond by supplying a prepaid returns label or refunding in full.
If they fail to do eith you can ask Ebay to step in.The option to do that will appear on day 4.

You’ll have to phone ebay. We had to do that as the seller told ebay they had sent a label and they hadn’t nor did they send one. The only way to get ebay to step in was over a week later by phone as there was no other way to do it available.

as long as you have made a claim for NAD with eBay, you should be fine, but if the seller says put it back in the post return to sender, DON'T DO IT.
You can use the call back link now if you want its 24hr now

It is day 4 and no option has appeared so I'll ring ebay tomorrow

Yes exactly the same for me they have told ebay they've sent a return label but they haven't and it's saying on return details I need to post back by 12th August, no option to escalate to ebay, I will ring them tomorrow

That happened to us as well.
It was an overseas registered seller but the goods were sent from a warehouse in Glasgow.
