Item not delivered to me but tracking says delivered

Hi, I'm wondering if someone can advise me of the best course of action.

My item was delivered to a car outside my house so it's marked as delivered. Royal mail have acknowledged this (I even spoke to the actual postman that made the error) and have requested the sender contact them to make a claim for the loss. 

Neither the seller, or Ebay will contact the Royal mail, the seller keeps saying they've used the "simple delivery programme " and Ebay keep telling me it's marked as delivered so there's nothing they can do.

If anyone has any suggestions I'd be very grateful

Firstly, what exactly do you mean by 'my item was delivered to a car outside my house'?

Are you saying that it was handed to someone in a car claiming to be from your house?  If so then you need to start by reporting it to the police and obtaining a crime reference/report.  You also need to try and obtain written confirmation from Royal Mail that the item wasn't delivered to a secure place.  Once you have obtained those you can try appealing to eBay again with that evidence and if that doesn't prove successful then contact your payment provider (PayPal or Card Issuer) for help.

When items are marked 'delivered' but have not been securely delivered to the Buyer it can be difficult to deal with because opening an eBay case doesn't work. You should already have some proof of the unsecured delivery when you look at the RM tracking. Check where was it delivered (photo), who signed for it (signature), and postcode (sounds like it matches in your case. Then after 9am ask eBay CS for a callback:

explain to them that the item wasn't securely delivered to you, but was misdelivered elsewhere / to someone else. In my experience they will refund you. If not go to your payment provider for a chargeback as already advised.

Thanks both for the replies. The person didn't try to get my parcel fraudulently, they pulled up to the postman with a missed delivery, Red card and the postman gave them my parcel by mistake.

The Royal mail have said they could sort this out with the sender by was of refund and compensation but don't seem interested in helping me get the parcel.

Unfortunately I paid via the Ebay balance as far as support from my payment method.

I will request the call back and also ask Royal mail if they can at least give me something in writing

What does the tracking information says right now? If it says delivered, and someone else took it but didn't hand it over to you, I'm afraid there is no much we could do. However, if you want, you can confirm the item number, and I'd be happy to send it for review to see if there is anything we could do, but again, please note that if the tracking information is showing the item as delivered, we might not be able to do much from our end.

Unfortunately it is saying delivered and the proof of delivery picture is just the parcel next to a car. 

The frustrating part is because of this simple delivery programme the seller is saying Ebay has to deal with postage complaints and Ebay are just saying because its delivered there's nothing that can be done even though the Royal mail has stated to me that the sender has to contact them. There is protection for these sort of things to cover the sender but not the buyer so I'm stuck with no real options to achieve a resolution. Just £20 out of pocket
