Seller cancelling but I did not request

Hi all 

 

Seller sold me a ps5.  I paid.  Before dispatch he cancelled the order giving the reason buyer requested. I did not.  I got a good deal but he seems to have changed his mind.

 

 

He has violated EBay terms by lying about the reason.

 

i am left with having to replace it at higher cost.


How do I raise this with  Ebay?

 

How don’t get his details to make a money claim online?

 

Any advice?

Yes,  you can raise this with eBay their lines are currently closed being a Sunday, but reopen shortly at 9 a.m. Contact them then, when the lines first open as there's more chance of Dublin answering.

 

This is very bad selling,  explain you did not authorise this cancellation, and were very disappointed not to receive your item.  

 

eBay will charge the seller a fee ,  and place a damaging defect on their account.  It doesn't take many defects for eBay to remove a seller permanently from their site.  eBay do not like unhappy buyers,  they tend not to come back to their site to buy.

Thanks.

 

Will they give me seller details to make a claim against them?  I cannot buy another items for that price - only more so I want to claim the difference.  I presumed having made a sale that their details would be visible

No, they will not reveal any seller's details, but a damaging defect will be placed on their account once eBay have been informed you did not agree to the cancellation.

 

You would not be able to claim the difference anyway from the seller, as  different sellers can,  and do , list the same item for vastly different prices.

 

Use the Best Match opton  >>  Lowest Item with P & P , to show the lowest price for that item being offered now.

 

It would seem your seller made a huge error in listing the item for too a low a price so doubt you'll find something of equal price.

The idea of raising a "loss of expectation" case could not be done through money claim on line. 

 

County Court or High Court?

 

The seller [if a business] will have a contact on his listing.  Using "buyer asked to cancel" will prevent any fees charged.

 

As advised all you can realistically do is report the matter to eBay [as you have I think].  They might not do anything but they will not tell you anything anyway.

I don’t think you are correct.
The seller made a deal he may have regretted but he also entered into a contract.  I paid and got the benefit of that contract.  I have lost out and am entitled to the benefit of the contract.  
The question still remains: how do I sue him or her?  I have contact the legal department but unless there are any other better ideas I will make a claim and ask a Court to order eBay to reveal the seller details in order to effect service.  
Has anyone else tried to do this?

The most you can claim in a 'loss of bargain' case is the difference between the 'bargain' and what you have to pay someone else for it.

 

It's really not worth it.
