Getting scammed? I have not accepted an empty box.

Hi guys, I have just purchased PS5 from a seller with over 2000 reviews. 
Evri courier just attempted to deliver the parcel. I have took it in my hand and it was clearly an empty box with my address and like label "weight less than 1kg"

I have not accepted this as I do feel like being scammed. He took it and said ok.

Now I have informed the seller, paypal and ebay. Its UK - England.
I have never experienced anything like it. 
Has anyone been in such situation?

Oh dear, you should have accepted the parcel and then opened an "item not as described" (i.e. the box was empty) case under eBay's money back guarantee.

 

Have you checked what the Evri tracking record states? The bad news is that if it is recorded as "delivery refused" you will have rendered it ineligible for eBay buyer protection.

 

If all else fails you may need to try PayPal or your credit or debit card issuer, to see whether they can help. However, you may encounter the same problem - that delivery was attempted, but you refused it. It may help if you can get Evri to try to get written confirmation that it was clearly an empty box. Start by checking what the tracking record states.

 

Sadly buyers often throw away the protection that eBay provides by failing to read and follow their rules correctly. The T&C state that damaged packing or empty boxes should be treated as not as described, which will require the buyer to be able to return whatever was received. It's possible that your empty box just contained a paper clip or elastic band, a common trick to get proof of delivery. The best possible outcome for a dishonest seller is if the buyer refuses to accept it. Good luck anyway!

Item I have purchased was listed as to be posted through Royal Mail and then seller has posted in Through Evri providing me tracking over ebay.

You should have accepted box, THEN opened a NOT AS DESCRIBED case to get a refund.

 

Now you have nothing to return for a refund, and attempted delivery is accepted by ebay as DELIVERED.

You should have accepted the parcel. Then, once opened and found to be empty you could have opened an "Item not as described" dispute which you would have won and got your money back.

 

Now that you have refused delivery you won't be eligible for the money back guarantee, the tracking will tell ebay that delivery was attempted and you cannot win a dispute.

 

I'm not sure if you would qualify for a chargeback with your bank, maybe someone else will know this.

Oh no... seriously? Should I ask Evri to re deliver? I mean I just in panic now to be honest. Is there anything I can do? Can someone literally can send an empty box? Is paypal and help then? It was clearly an empty box

If you can ask Evri to redeliver then you should do so.

Thank you, I will try to contact evri on Monday morning and then my back if necessery. I can't believe it that refusing obviously empty parcel would be the wrong option. Thank you again for your help

Would it matter if the seller is a business seller with over 2500 feedback? Would it make any difference. Thanks

Hi everyone, just a quick update on the case.

Seller has owned up to this and apologies. Seller has refunded me full amount - I am all good there.

I am all aware of scams online; I don't buy anything from people with no feedback. From accounts that 

have been created recently etc. How can I protect my self then?

In my eyes it was right thing to do to do not accept an empty box. 
I could simply order a something from someone and then accept it say nothing is inside and then what?
What if I sell something on ebay and someone says that there was nothing in the box  - am I protected as a seller?

 

How can I learn from this, how can I be smart about it?

Something doesn't quite add up here.

 

I do wonder if the seller hasn't made some kind of mistake.

By understanding eBay's rules and the risks of buying and selling here.

 

You've had a lucky escape. Refusing to accept delivery removes eBay's buyer protection. But did you know that eBay treats attempted delivery as being successfully delivered? Even though it wasn't delivered. So simply missing a delivery can also remove eBay's buyer protection. Not that this happens very often as if no-one is in parcels today are often dumped on the doorstep. But if the item is then stolen before you get home this isn't covered by eBay's buyer protection either. Not to even mention the problems if delivery is claimed, but to the wrong address.

 

eBay is a hugely risky place to sell things too - in fact the risks for sellers are far greater than for buyers. Apart from delivery issues, eBay's money back guarantee is heavily weighted in the buyer's favour and wide open to abuse.

 

eBay is a jungle.

Thank you for your reply. 

I guess the best way to avoid anything like it would be to not skimp on deliveries. 
Get a delivery that its either a locker or a singed for.

I will be more careful next time.
