New games console does not work, seller will not respond to my messages

I bought a new Nintendo switch console for my hubby for Christmas, it was bought at the end of October. He opened it on Christmas day, and it doesn't work. I contacted the seller on boxing day, but he says he doesn't accept returns, and now will not answer my messages. What do I do now, the resolution centre won't let me do anything as its past 30 days, but my consumer rights should entitle me to a repair or a replacement for a faulty item surely.....Help....Debbie

Open a paypal claim you have 180 days from purchase date..you only have 30 days on ebay to open a claim

You need to open a claim with PayPal as you are past the cut off time to make a claim with eBay.

Ebay can't help you unless you open a case within 30 days of the delivery estimate on the order (read their 30-day Money Back Guarantee, which is on every listing, in various other places across the site, and on your order confirmation). So open a case in PayPal if you paid through them, or with your card provider. You have 180 days from purchase date with Paypal (and with most major card providers).  Do not close the case on a promise, and do not opt for repair or replacement.  If you want another, buy again so that you have a fresh transaction number should something be amiss with that one too.

You muyst open a case within 30 days of purchase - purchase history, click on more actions against the item, click on return this item, click on your choice then follow eBay instruction.  Please ensure you have given the item every opportunity. Accept only eBay instruction not seller promises.

Your consumer rights should indeed give you that, and you still have them.  Ebay's MBG is in addition to those rights.  The difference is that you have to pursue those rights on your own.  Alternatively, you could try PayPal, but you would need to convince them that you didn't test it until Xmas.
