GPSR Compliance

This is as clear as mud to me. Been to the gov. advice website and various others.
How does a 1972 poster fit in to this process?

It's not an exempt category. 


Advise buyers this item is for viewing only ? 

My initial reaction, sadly, to to switch EU and NI off.

A customs declaration is not required but an entry summary declaration - which is not a customs declaration - will be required from September 30th. It seems RM and the couriers can make this declaration - something I wasn't aware of so thank you for that information. However, eBay will not let you ship to Northern Ireland unless you provide details of an NI representative due to the GPSRs - that is also a role performed by the TSS. From GOV.UK:

 

"The government and the EU have agreed the Windsor Framework. This includes details about the arrangements for moving consumer parcels from Great Britain (England, Scotland and Wales) to Northern Ireland, from 30 September 2024.

 

The UK Carrier (UKC) Scheme is an authorisation that enables businesses to move eligible consumer parcels, from Great Britain to Northern Ireland, in line with Windsor Framework arrangements.

 

UKC Scheme authorisation will allow your business to send these parcels without completing any customs, or safety and security declarations.

 

You can apply to use the UKC Scheme if you’re responsible for moving consumer parcels from Great Britain to Northern Ireland. Consumer parcels are defined as those moving from:

Any business not registering with TSS & UKC to use the green lane for goods not manufactured in the EU will have to employ an NI representative due to the GPSRs; as the TSS will perform that role for free it would seem daft not to use them. It just depends whether eBay understands what the TSS's role is or not when it comes to businesses who want to ship to NI - but not to the EU - after September 30th.

Give me ambiguity or give me something else.

The 30th September might be a fluid date, latest TSS bulletin suggests thats now 31 March 25:

Yeah, I've also just received that update from the TSS.

 

If they can do that for the implementation date of the Windsor Framework, that gives a bit of hope that they might put the December date of GPSR implementation onto the long finger.

Thank you for that. Well, things are certainly going to get interesting as the GPSRs will be in full force from 13th December.  

 

Out of curiosity have you entered the TSS's details into the "Manufacturer -> EU Responsible Person contact" box under "Item disclosures"? As your items don't require a CE mark that should be all you need to do in order to continue selling to Northern Ireland. Obviously I'd advise against using all your items as guinea pigs for this - I have one listing that doesn't require a CE mark that I'm using as a guinea pig so it will be of no great loss to me if eBay hides or removes that listing on or before the December GPSR deadline.

They're disparate things. The EU Commission is highly unlikely to delay the implementation of their GPSR enforcement simply because it will negatively affect a small province which is part of a country that stuck two fingers up to it.

I'm still trying to get my head round it all.  I can't work out my own moral stance.

 

I chatted with Liv Ellingsen, eBay Regulatory team at the event.  As posted previously the unoffical advise was keep on, keeping on. 

 

She seamed like a very switched on genuinely interested to help lady, but I'm not sure I can do that.  I'm the sort of person who gets full HMRC audits - like this January.  Every bank statement, invoice, bill, sales invoice etc for a twelve month window.  I've been audited before. 

 

I've now exchanged business cards with her and I'm forwarding the less agressive communications I've had from other platforms and details that @4_bathrooms linked to about TSS and the Carrier programme (both of which I've signed up to to continue selling to NI post Dec 13th.) Not sure it was on eBays radar - but she was rather in the line of fire and emotions are obviously running high about this so I may have missinterpreted her response.

 

I'm still hoping a stance will be taken on items available for sale in the EU prior to Dec 13th.  That would buy us all a bit of time

 

My actions so far have been to add a line to the end of every listing this was available in the EU prior to December 24.

Sign up to TSS and the carrier scheme

Express my concerns over unclear messaging to anyone who has crossed my path from eBay.

Ask eBay if there is some way that they can engage with a third party to provide the EU economic operator/ appointed person role - which I have been updated on is still something potentially on the table.

 

I haven't added TSS info to listings - I've banned myself from getting involved in it during the normal working day.  This will start mid November if no further advice has been received. 

 

EU and NI is not a massive revenue stream for me at present.  I'd be sad to switch of Europe as I do sell some stuff but I will have completed this years international peak season sales by Dec 13th so its next years revenue that will be affected not the current one, by holding my nerve to not switch off until its absolutely necessary.

Yes, an entry summary declaration has to be submitted, that is the carrier's responsibility and is not something we as a seller can do ourselves. This can be confirmed by the TSS section 1.1.  When it comes to the Royal Mail for example and B2C parcels, all the details they require to complete an entry summary declaration we already provide when buying a label through Click & Drop or the Royal Mails website. 

 

The UK Carrier Scheme is for the carriers, as in Royal Mail, Evri, DPD, Eddie Stobart etc, not sellers.

 

TTS is a tool for the carriers and importers based in NI, and it does not seem they can act as your person of responsibility TSS Beginners Guide

What an utter nightmare this has become. I pity the residents of Northern Ireland as the choice of goods available to them via mail order from the mainland is about to reduce massively.

I agree, probably circa 80%?

There will be opportunities though for any businesses that can actually be bothered with all the overly difficult paperwork.

As I understand this it requires all goods sold to an EU country will need to have the original safty paperwork or copies of that paperwork supplied with the goods. So is will apply to goods such as electrical items or other types of goods which are of the type which require such paperwork. So any thing which need to be operated by someone. If I am correct it will also mean all used items as well as new goods. We sell used equipment and this equipment does not come with this paperwork when we buy it therefore we will not be able to sell these items into an EU country. Now if this law is adopted in the UK or if E bay require it for goods sold in the UK it will collaps the market for used items. There is an other item of interest, if you are a business seller you will see the wording E bay has inserted near your busines in formation which states ( This business complies with all EU laws) I have asked E bay for clarification on this but they have not replied, so it would seem  we all will need to know much more about EU laws even if you do not sell into the EU.

As far as Northern Ireland is conserned we have just sold a large machine to a customer there and for the first time ever we needed to appoint an agent to handle the paperwork at a cost of over £200. We have sold goods to over forty  countries and this is the first time we have had to have this kind of help. Up to the tome of this sale we were anle to provide all the paperwork ourselves.

Sadly dropping EU and NI is the only sensible procedure until the dust settles, then once the full scope of the impact is seen, then maybe an alternative may be established by the EU and Govt.

At that point then returning to sell to the EU and NI may be reviewed.

Its strange that other platforms are muted on this change, and ebay seem very proactive toward its implementation.

EBay have more published knowledge as you say than any other platform. However, other platforms will highlight and state exactly where and when our listings, and there for our businesses are safe now and moving forward.

 

we have all asked one simple question. "If we remove listing from NI/EU,  are OUR LISTINGS SAFE?"

 

This has been asked so many times and yet no one at eBay will give us a firm published answer.

 

This is ALL we need for the moment.

I am wondering about this as well. Obviously we are obliged to follow Ebay international selling guidelines which includes "When you sell internationally, you need to make sure that the item you're listing can legally be sold in other countries, as the applicable laws may be different to your own country" but why just specify the EU? Will they next be putting on that I comply with all US/Chinese/Australian/every other country in the worlds laws?

Most of the items we are selling are B to B and of value in the thousands of pounds. We have not sold high value items into N I since we left the EU. We have been advised that customs paperwork ir required and for that resion we used an agent which we had to pay for. This is the first time we have had to use an agent for this type of work and we found it was worth the money paid. We have sold to over 40 countries and always compleated our customs forms so the use of an agent is new to us . The item was sold on a Classified ad so the sale would then not go through the E bay system

You must rember that not all sales go through the E bay system. We sell as lot on E bay classified ads and we therefoer have to arrange our own shipping abd Customs clearence.

I've been doing the same adding myself as the manufacturer. I have 2 already up which bought from a wholeseller in the uk. They're on two listings.
