A buyer has with ebays permission, returned a pair of calvin jeans saying that they were too big.

I advertised them as per the label size waist 36. Surely this cant be right that someone can return something and cost the seller money when they just dont like the jeans. I put plenty of photos on.

 

Any help would be appreciated

Buyer obviously opened a Not As Described case, you did not provide a return label, so buyer escalated to ebay who I assume provided a label at your expense and on return refunded again at your expense. You get a Defect and no refund of the selling fee.

 

It does sound as though the buyer abused the Returns system, but ebay always goes for the buyer, and you have found this out the hard way. 

 

In the feedback page there is a "Report the Buyer", but it will not get your money back. 

 

Once a case has been opened however much you feel you are being taken for a ride, it pays to deal with it yourself as it works out cheaper than having ebay get involved.

Hi Mark,  Distance selling (ie buying goods online by any method) carries different regulations to buying from a regular shop.  The customer has the right to return an item without needing to give any reason whatsoever for the return.  The return cost of the item is met by the buyer, but when you refund you are required  to refund the original postage also.  The only time eBay will send the buyer a return postage label at your expense is if the buyer says the item was not as described,

If it is a Miss Description Case you would have been liable to issue a Returns Label charged to your Seller Account.

 

If Ebay are now involved you will have to Fully Refund when you get the Jeans back. Your Ebay Final Value Fees will be Credited back to your Seller Account. If you don't you won't Receive a Few Credit and would be issued with a Damaging Defect on your Account.
