eBay are now responsible for refunding buyers where items get lost or damaged in the post and are sent after 4th February when the new Buyer Protection kicks in (private sellers only)

Will this protection apply to untracked items?
If so, I can see potential for lots of scams!

I also got refunded when I received a faulty item as a private seller.
I didnt have to send it back.
Seller refused to send returns label.

The buyer protection fee is not about refunding buyers when an item is lost or damaged.

This is a good one, sold perfume, eBay chose the couriers, not me, I included collection in person,
received the label from eBay to print out, buyer paid eBay for the postage not me, they chose evri. Parcel has no been “lost” so who now pays the buyer? Me, or eBay, yet any states the buyer isn’t covered due to a prohibited item being sent, I did not know this about perfume, I did not chose the postage, I did not chose the courier,
so will I now be out of pocket??

1. Has the buyer raised an Item Not Received case? If not, you have no obligation to refund the buyer, AFAIK.
2. Perfumes are prohibited from Evri as mentioned in the Evri link here:
"Items posted with Simple Delivery also need to comply with the prohibited and restricted items guidance and packaging requirements set out below, as well as the policies of the carrier.
We recommend checking these policies and the guidance below before you print your Simple Delivery label and before you bring your parcel to the drop-off location."

That’s the thing. I didn’t choose the postage the service or anything to do with it, the buyer chose evri and paid eBay for the postage label not me.
eBay sent me the postage label. I had no idea that sending perfume through evri wasn’t allowed, surely if eBay deal with the postage they should know this and not offer that postage service
I know exactly where this will lead and it will be with me being out of pocket

Actually ebay chose Evri not the buyer.
You (probably) listed with Simple Delivery and those are the terms and conditions.
If you listed with your own postage and ebay changed it to Simple Delivery (which has happened for some people's items - mainly a few months ago), then you might have a point. But ebay would probably still refer to the "We recommend checking these policies ... before you print your Simple Delivery label ..." bit.
I posted a reply in May saying there's no statement from ebay on what to do with prohibited items [and my suggestion], and I didn't receive any response for months, whilst I was still reading the discussion boards. (I don't read them much any more but I'm not aware of it ever being answered.)
