EBay asking for national insurance number

Hi everyone, I recently joined for like 1 month and I start selling as a private seller , and now eBay is asking me to provide national insurance number.

"New UK digital sales reporting legislation requires sellers with 30 or more sales, or who have sales exceeding £1740 in a calendar year, to register this information"

HMRC don't write to you to ask for your National Insurance number because
they already have it. If you ever receive communications from them they
usually quote it on their letter head. Ebay only want it so it can then be
matched to your earnings which will easily identify you when the
information is submitted.

"So why don't HMRC actually write to us to ask for our National Insurance numbers?" - As has already been mentioned HMRC already have your National Insurance Number.   So many people now receive money via digital platforms now it needs to be identified due to the disparity between the calculations of money within the economy and the taxes paid.

 

The aim is to identify not only where the missing money is going but whether it is being used or obtained from criminal activities.  Tax evasion is just one of the areas identified; along with people trafficking, drugs income, corruption involving public bodies and officials, etc., etc.  The aim is also to identify the cross-border transfer of money involved in such activities by digital means.

 

HMRC, with the software they now possess, can quickly identify whether a persons income and lifestyle matches that being obtained through PAYE, benefits, savings, etc.  If there is a disparity it may flag an alert for investigation.

 

With regard to digital sales platforms it will allow sales income to be included in any such assessment and can be also matched against a seller's purchase history.  You have nothing to worry about unless you are trading under the radar; and even then only if you are receiving money above the £1,000 trading allowance.  HMRC's trading definitions are set out on their website under 'Badges of Trade'.  These do not involve the selling of personal possessions unless you are lucky enough to have something that falls within the remit of Capital Gains Tax.  If you are concerned or worried just check out the HMRC website; after which if you are still worried speak to an accountant rather than advice on these boards; some of which is good but in many cases ambiguous, or just plain wrong.

HMRC don't write to you, because they are not to know you are selling on
ebay unless of course you have told them so. Thats why ebay is looking to
furnish this information so that earnings and NI Number can then be neatly
toed in together!

They don't need to share it.  Most people's data breaches are caused by the person themselves not taking due care when using emails and social media, together with responding to telephone calls and texts.

 

If eBay were to do as you suggest it would certainly be a very quick way to end their business in the UK and probably throughout Europe.

ebay are not your employer, niether is HMRC..why give your details to them..i will not..and they will never have my details..they have no right to ask and hold funds.. i have always done my own books..ebay can do one

As a Reporting Platform Operator eBay is legally required by 'The Reporting Operators (Due Diligence and Reporting Requirements) Regulations 2023' to obtain a seller's details, including NI Number, so whether you like it or not they have every right to ask.

 

Withholding funds is not a mandatory requirement of the regulations but is one of the suggested methods for enforcing compliance in the OECD's Model Rules. 

 

Your tax obligations as an individual are completely separate to eBay's legal requirements as a Reporting Platform Operator.

I agree this probably WAS the case but lately its concerning that M & S and the Co Op have had awful data breaches.     I had an issue with British Gas last week and they told me that they are concerned they may be in a similar situation.

 

I defo would not trust Ebay with further personal info at the minute.

Also, haven't there been reports of several banks whose customers could not access their accounts and balances to make payments ?

 

I don't know if that is down to hackers, data breaches or something completely different but to someone like me who isn't very good at techie stuff, it just seems that doing things on-line isn't any more secure now than its ever been.  

 

Someone I know told me that even the local Tesco had a problem a week or so ago, they had to put staff on the entrance to tell people that they could only pay with cash, not cards or apps.

 

I know that none of the above is directly related to NINOs and ebay, but shouldn't we all be a bit worried when electronic money and payments seem to be so fragile and insecure along with all the security data that goes with them ?

There is no legal requirement for you to give your NI number to eBay. It is eBay who want it, not HMRC they already have it.

"There is no legal requirement for you to give your NI number to eBay." - correct, but there is a legal requirement for eBay to request the information from you, once certain criteria are met, as explained by @sml192  above in post # 309.

 

To ensure they meet the due diligence requirements eBay will be required to demonstrate they have carried out a meaningful process to achieve this.  Sanctions against non-compliant members is the obvious means and this can include the withholding of funds followed by suspension of selling activities.  This applies to all digital platforms, not just eBay.

To be honest it is concerning about all these data breaches lately....even todays news contains a breach of the Criminal Justice system going back to 2010 !    They think its some criminal gang.  It relates to anyone who may have applied for Legal Aid whether that be in a criminal or civil case 😞

 

We recently had an issue with our internet provider too......again very worrying because although our payments were going out the bank every month they were not being credited to our account for some unknown reason.   An hour plus on the phone to sort it and get our services reinstated.

 

I think at the moment whether that be Ebay or anywhere........the less info they have the better.

HMRC have not asked eBay or any other platform to provide them with your NI number. Anyone who does is giving away their most sensitive information. I advise anyone not to. HMRC have all they need to distinguish whether you are liable for tax. When you sell a million pound painting at Sotheby’s, they don’t ask you for your NI number.
Feel free to give yours. I won’t be, and as for putting their restrictions in place, they already have for private sellers, with restricting their visibility on this ever failing platform.

Incorrect, obtaining Tax Identification Numbers is a requirement of the regulations:

The information that must be collected is set out in the model rules. This may include data that Reporting Platform Operators (RPOs) will already collect as part of onboarding and registration processes, or for AML/KYC purposes.

  • First and last name (and middle name if this is provided)
  • Primary address
  • The Tax Identification Number (TIN) issued to the Seller by the jurisdiction that Seller is resident in, and the jurisdiction of issuance.

    • Primary address

      Where the Seller is renting immoveable property on the Platform, the RPO must also collect the address of each property listed on the Platform (see 902520).

       

      This information ensures that HMRC and tax authorities in partner jurisdictions can correctly identify the Seller (or rental property) and can match the reported information with the relevant data held about the Seller (or rental property) effectively. RPOs must therefore take adequate measures to ensure that the information items above are obtained.

Somewhat surprisingly I've yet to see any mention of their intention to ask anyone for their NINO on ebid.

 

After the ebay announcement that it would require all private sellers to hand them over there was a short discussion prompted by others who sell on both sites. 

 

The Management over there has never mentioned it, no-one has come to their boards to say they have seen anything to indicate that the site is planning to ask for them  --  Nothing.
