buyer scammed

I purchased a 50g gold britania bar on ebay. paid with paypal. initial messages with seller were a bit sketchy but eventually got a evri tracking number. Then ebay notified me the item had been delivered.I did not receive it but recognised from the courier photo that the item was in a neighbours post box. I went down to fetch it , addressed to a different person and house number,delivered by royal mail not evri inside was a phone case no gold bar, the tracking label had parcel weight of 44g. so the gold had never been sent. I contacted the seller who replied the item was still on its way, next another notification from ebay saying delivered, again parcel delivered to another address and another name who didnt live at that address, the local delivery driver then brought it up to me as i know him. inside a sky router, package weight 1kg. Then notice of another delivery and tracking to my address, this again delivered to a neighbour wrong number and name, inside was a lip balm parcel weight 22g. I raised a case with ebay. Also with paypal as urgent because of the many thousands missing. Ebay then closed the case because they said paypal was dealing with it, then days later paypal say im not covered because the item which i never received was gold. Ebay then will not reopen the case because they automaticly close the case when payment providers are involved but the payment provider paypal wont cover it. Surly ebay should tell me before they close a case and why so i could retract from paypal. I paid £72 payment protection knowing i was covered for everything. I have no idea what to do now.

You cannot open a case with ebay and with paypal at the same time.

Ebay will automatically close and you cannot reopen. Surely you can see that you cannot claim TWICE for same item.

All you can do now is pursue it with PayPal.

Unfortunately Ebay rules are that you cannot pursue a claim with Ebay if you start a case with your payment provider.

They do make this clear in the Money Back Guarantee terms:

 

Your payment provider may also offer a buyer protection programme. A purchase will no longer be eligible for eBay Money Back Guarantee if you choose to seek resolution through your payment provider for the same transaction, regardless of the outcome of that dispute or claim.

Your bank may still be able to help you pursue a chargeback even though Paypal have not been able to, or you may have to take legal action.

I have never known a seller to send so many fake packages before.  You may need to gather some evidence of a fraudulent transaction.  I think would be useful to retain the package that matched the tracking on the Ebay transaction.  If it has a weight on that shows it was clearly not a bullion bar and is addressed to a property which is not yours that may help you.  However, there is nothing further you can do through Ebay.

I did not realise i was claiming twice i thought they was one of the same and urgently wanted to stop the payment been made
