What action to take? Seller didn't send my item (phone)

Hey all, 

 

I recently purchased a phone, the seller promptly marked it as dispatched, but parcel force tracking says that no one was home when they went to collect the item on the 23rd. 

I waited until today (29th August) to message the seller to ask if they were going to post the phone soon, and the response was;

 

"I canceled by the Ebay advices..."

 

However, the sale was not cancelled and is still awaiting postage. I asked the seller to correctly cancel the sale so that my refund would be processed and the response was; 

 

"I recently spoke with customer service regarding my issue, and they advised me to cancel because I was given an incorrect address, which was not safe to use. Additionally, customer service noticed that the response I received was linked to a different account, which adds to my concerns.I recently spoke with customer service regarding my issue, and they advised me to cancel because I was given an incorrect address, which was not safe to use. It seems like they are trying to make me look like the scammer. Ebay wont help for a few days as "the item could still be on its way".

 

It seems like my only option is to wait until eBay allows me to mark the item as not delivered. Or is there something more that I can do?

Really you can do nothing until overdue, when you should open a NOT RECEIVED CASE.  Seller then has 3 days to either deliver or refund. If no response escalate on day 4.
