Trying to get a refund, but apparently out of ebay money back guarantee and seller has not responded

So I originally bought my item on the 26th February and the item showed dispatched around 4 days later and never turned up after a month, So I messaged the seller and waited another month but never got a reply so then I opened up the item not received case on the 26th April which the seller has also not responded to; I also sent another message to the seller to enquire what was going on but for the 3rd time I have had no response.

 

I have now asked ebay to step in but the system now say's that it is past the money back guarantee and they can not help, what is this? all I'm asking for is my money back from a seller  who has stolen my money (and also sold over 95k worth of products). But I'm getting nowhere, I cant talk on the phone since I won't have my voice for the next week or so.

 

What do I do? Do I really have to take it legally over £5?

"Not received" cases have to be started within 30 days of the estimated delivery date.   It looks like yours is past that so it's too late for ebay but contact your payment provider about getting a refund.

Okay thankyou both for the fast response, usually I give sellers just over a month for  benefit of the doubt and then message them if I haven't received the item by then, look like I will just have to go my estimated delivery from now on. I payed by debit so I will try and contact my bank at some point to see if it is possible. Thanks.

That is too long to then ask eBay for help with a refund.

 

In my humble opinion that is way,  way too generous a time limit,  if an item has not arrived in weeks let alone a month,  it's not going to arrive.

 

eBay have a 30 day MBG,  Money Back Guarantee policy.  If you wish any refund from eBay for an item not received,  you need to follow this policy,  which means you open a case for item not received one day after the item's last estimated date for delivery,  and within 30 days of that last estimated date.
