Supposed Counterfeit Football Shirt

My Son recently had his account suspended and shirts returned because some of the shirts were supposed to be counterfeit.

I  referred a shirt directly to a Premiership club shop and their shop was unable to determine if the shirt is counterfeit.

The shop have now referred me to the company deemed to have made the shirt so that further checks can be made.

How is Ebay able to determine a shirt is counterfeit when the football club cannot? 

Something not right here.

Has Ebay been influenced incorrectly?

Without seeing his account details we can't advise properly. 

Is your son over 18, he can't have an ebay if he isn't. 

Be warned if his account is suspended, ebay may associate this account and suspended it as well.

He is Autistic so I am acting on his behalf.
I am going to send your warning to the Ebay Ombudsman as I deem it to be a threat.
I have written to Ebay about this matter

The two questions you have asked cannot be answered by other members.

We don't know how Ebay determine that items are counterfeit or if they have been 'influenced correctly'.

It seems from your previous thread that some items were removed and then relisted ... that would lead to a suspension.

 

As you were advised then, you need to discuss this with Ebay.

It is very unwise to post so many personal details in an open forum and it is likely that your post will be moderated to remove those details.

Like the information in the response from @tobiasd4 , that is not a 'threat' but well meant advice/information from an experienced member and mentor.

ITs not advisable having your personal details on display if you can remove them do so.

 

Ebay never see the items, so they cannot determine if an item is genuine or not, however with many of these types of items, there is the Vero programme, so in your case for example the football club could have rules in place that only new shirts are allowed to be sold by certain business's to ensure that only genuine products are offered. If an item has been pulled down then don't try to relist it.

 

@tobiasd4  was not threatening in any way, but just advising correctly of the situation. We are buyers and sellers like yourself so we don't have any account access, but help as many people as we can on a daily basis.

There is no eBay ombudsman. eBay's handling of customers' payments is regulated bu the FCA, but they won't be involved in disputes over copyright.

 

It will not be eBay what has decided the shirts are counterfeit, it will be the brand rights owner under eBay's VeRO scheme. eBay once faced a multi-million euros class legal action for allegedly failing to do enough to prevent the sale of counterfeits here.

 

eBay now enables registered rights owners to register their intellectual property (and in some cases, distribution) rights. When a registered rights owner reports an item as counterfeit eBay will immediately remove it from sale. The judgement whether it is counterfeit is made by the brand owner, not eBay.

There are a number of contradictions to what you say in emails from ebay mentioning the rights owner making complaints.
This is why I have started approaching premiership clubs with the shirts identified as counterfeit.
There was no reference to not being able to sell used shirts.
Most shirts are in an as new condition as they were displayed and then hung in a wardrobe.

I sorry if you misunderstood my comment about your suspension.

If you & your son use same computer or ISP, ebay can associate accounts & MAY suspend yours as well.

They do this to stop the other account using yours to get round suspension.

This is why your son needs to sort his issue with ebay.

Only ebay can do this.

Thanks for the clarification.

If your Broadband Router is configured correctly the outside world will only ever see 1 IP address.
The exception to that would be for a user to open ports on the router.

There will be other ways that ebay will link accounts to which we are not privy but we have seen many examples of these links taking place and associated accounts being suspended.

 

You are simply being warned that your account may also be suspended.
