Hi guys I'm a little confused I've been told I can't sell used makeup due to hygiene reasons but I can see other makeup on Ebay right now that is listed as used. I've purchased used makeup before some were so heavily used on there you see the pan! Is this a new rule? When creating a listing its not even giving me the used option so I don't know how others have managed to list theirs!

It is not allowed - this is from Ebay's cosmetics policy:
'Listings for used cosmetics, sponges, or applicators are not allowed. This includes products such as skin moisturisers, sunscreens, perfumes, lipsticks, fingernail polishes, eye and facial makeup preparations, shampoos, permanent waves, hair colours, toothpastes, and deodorants.'
If you list in the cosmetics category, you can't choose 'used' only 'new/new other' which says it is a completely unused item. There are always sellers prepared to deceive potential buyers - you can report used items and, if you buy 'new other' cosmetics which are clearly used, then you should open a return and send the item back for a full refund.

Other sellers have breached eBay policy by listing it as new, as you've discovered make up can't be listed if it's been used (it's a health hazard).
If a buyer purchases used make up that's been sold as new from any of those sellers then it's not as described and they may return it (at the sellers expense). If eBay spot it, or it's reported (reporting route below) then the sellers account will be sanctioned.
