Just bought a pair of jeans. Advertised as 36 inch waist and labelled as such. However, they are much bigger than this and when you physically measure them they are at least 38 inches plus they are also stretch denim so probably would fit 40 inch waist. The seller has declined my refund and I’ve just ended up going round in circles as apparently it’s closed and I cannot appeal. So I’ve paid for something that I cannot use that I bought in good faith.

All you can do is contact Ebay Customer Services and explain the issue as you have done here.
Explain you now know that you should have opened a 'not as described' case but you used the reason 'doesn't fit' and the case has been closed.
Ask them if there is anything they can do.
They have options - they can:
Say nothing can be done
Open a new case for you with the correct reason
Give you a discretionary refund.
They may just say nothing can be done. But I would ask.

If you used "Doesn't fit" as your reason for return eBay consider it to be a change of mind which sellers can refuse. If the label was wrong you should have used "Not as described".
You can't open another case but contact your payment provider and see if they can help. Or resell them yourself with correct measurements in the description.

You should open a not as described case, do not use reason Does not Fit, as that would probably close as a change of mind return, just use NOT AS DESCRIBED, then seller has to provide return label and on receipt refund.
