I bought a battery for my camera which arrived safely. However, after many attempts it wouldn't hold charge. I contacted the seller who told me not to bother sending it back as he was going to send another. The replacement has still not arrived. There is no proof that it has been despatched. I contacted the seller again and he said he would give a refund. This has not materialised. So I contacted eBay to intervene who are saying that they have no record of my request. I have been on the website, and tried phoning, to try and speak to a human being but it is impossible to get past the robot. Has anyone got any advice?

If it's still within 30 days of the delivery date open a return on here:

If it's more than 30 days it's too late to do anything via ebay but contact your payment provider and see if they can help.

Are you still within 30 days of the item's last estimated date for delivery, then proceed as below. Hopefully the seller hasn't timed you out with their false promises of a replacement.
Go right of the item in your Purchase History, and from More Actions select Return this item, selecting the reason... Item Not as Described.
The seller has 3 days to accept the case, if they don't , you need to escalate on day 4, or within 30 days, and eBay will step in and force the refund.
If the seller wants the item back first, they need to pay for a fully tracked return postage. On receipt of their item they have 48 hours to refund you. Again, if they don't, you escalate the case.
Do not close the case early for any excuse or promise the seller may give, and do not forget to escalate.
if you're out of time now, turn to your payment provider for help with a refund.

It looks as if you have left it too long to open a return through Ebay.
You could try your payment provider.
