Ebay refuse to acknowledge mis-delivery

Evri delivered a parcel to the wrong address. As proof of delivery they supplied tracking and a photo. The photo was not my address. I contacted the seller - who said it was not his problem as it was sent by Simple Delivery. I contacted Evri - who said the tracking shows it was delivered (didn't matter where) , and I should contact the seller. I opened a case with ebay - who refused it because the tracking said that the item had been delivered. I then appealed the case, with photo evidence of another (different) Evri delivery to my address that showed a completely different front door. This proved that the first parcel was delivered to the correct address. Ebay refused to acknowledge this as, according to them, tracking proves delivery - even though the photo showed the tracking was not the correct address. I have no refund, no item, and ebay ignore their responsibility under their money back guarantee. I have pointed out to ebay that, legally, tracking does not prove delivery, a digital photo does.  Any suggestions, please?

This is a common issue.

Ebay has to go by tracking. 

Although you say you provided photo of your door, like Evri picture, does not prove it is your door.

Try your payment provider.

No - Evri provided the second photo of the door (on the second dlivery), as
they did the first. They can't both be right. One must be the wrong
address. Tracking is different on both deliveries. They can't both be right.

Ebay will only accept tracking as "proof of delivery" - not even the photos or signatures that are legally POD, of doorbell camera footage.  And, according to Ebay - the tracking only has to be within 100 feet of the correct address.

But - despite having my case for lost item declined, despite having the appeal declined, and being told the decision is final, despite being told by customer services that the decision was final and could not be overturned, I have now got my refund!

Keep on arguing, and they will eventually back down.

That's  good news, that you've received your refund, and yes I agree perseverance, and it can make a lot of difference for an outcome depending on which Customer Service agent you speak to.
