taking ebay to small courts

Its probably done many times but as a BUYER i felt ebay tricked me in to such scam. I bought a motorcycle foot rest ( second hand) and the buyer promised that it fits to my bike. When the item arrived it didnt fit. I open a case for a refund , 3 mins later refund is refused and the case is closed. It has been 2 weeks of writing to Ebay about "ebay money back Gurantee" but representitives are not trained to handle such cases i guess. All they said was Seller can refuse the return "EBAY CANNOT DO ANYTHING ABOUT IT! " ? wow ! just wow ! i have been selling on ebay for the last 13 years never been allowed i repeat never been allowed as small business to not accept returns. When i called or email ebay they said to me that as a seller i must accept returns. And no i am selling a second hand piece of *** to people which is cost £60 i am selling electronics which can be heavly damaged and ebay a few times didnt listen to me about electronics shouldnt be returned ! now the same ebay not allowing for a return for a piece of metal cost £60 ? how the *** is this ? what is the logic ? i really trying to learn this , its not about money its the principle ! ebay charged me for "MONEY BACK GURANTEE" its like 2.49£ it shows on the page when i was buying ! it has been 5 days now i have been reading about the returns and the small print, and finally got Ebay from the ***! i could take them small claims court and really cause them a damage alot alot more then £60. But as a human i am thinking is it really worth my time and energy ? Why ebay is this way ? What would you do if ebay refuse your rights as consumer returns ? i already give 1 start to the seller and then also gave 1 star to the ebay as they have been really bad. But how unreasonable ebay can be ? for £60 i am going to use the system fully ! i am going to tell people i am going to ask people to be very carefull when they are buying from ebay ! this will cost ebay 1000X £60 from sales. why ebay is so bad? i never experince this with Amazon ?

If the part was advertised as fitting but didn't,  then you had to use one of the 'not as described' reasons when making your claim.  Then it will be covered by the money back guarantee. 

'Does not fit' counts as a change of mind return and is not covered by the money back guarantee.   Private accounts do not have to accept these returns and can reject the claim.

If the item was misdescribed and you opened the wrong ebay case, ebay won't help you now.  You could try your funding source for help.

i didnt sadly ! for a moment of stupidity i just blanked and i pick the part is not fit. But funny you said that about "does not fit" as when i told the ebay representetive he mentioned that i should have say "change my mind" , after that i think you might be new to the ebay mate , i am a private account and my wife has a private account specially private accounts can not , i repeat CAN NOT say i am not accepting refund.  i have been seeling in EBAY over 13 years unless they changed something. I wish i can say all my items as not accpeting refund, there is no option as such. Anyway yes ebay not going to help me and its too late for my bank to do charge back. I have been nicely scammed by ebay. This is only can be described as scam, because this is like words play, For me all i can see is does not fit , or i change my mind, or not as described is perfectly okay for RETURN, as i have been returning electronics and losing so much money with it that it force me to stop selling on ebay. I am going to look in to this, like wow only if i can say i am not accepting returns that would be amazing ! but %99 sure thats not possible by law.

can you able to tell me how to not accept returns ? i have been trying it for it now at least 10 minutes there are no options. how can a private seller or business seller can put no returns to their sale ?

The account you are posting from is a business account, businesses have to accept change of mind returns, it's the law.

Private accounts. which are not meant for businesses, do not have to accept change of mind returns as the law does not apply to them.

If you and your wife have private ebay accounts you will be able to choose not to accept returns.

yes but how? there is no option to not accept return ebay doesnt let you to advert without choosing the return acception of 14 days returns !
