I pre-ordered a comic but not received it (seller says their supplier is understaffed)

I pre-ordered a comic April 22nd and the comic was due to be released 27th of May. The seller marked it as dispatched but said they had to, to keep in line with ebay policy. The seller said after I later messaged him, that the supplier would complete their orders by the June 24th. Message them again June 30th and they said they still haven't received them as their supplier is understaffed. It's been over a month since the comic was released. Should I just try and get a refund through paypal if possible? this is my first time pre-ordering something on ebay so I don't know if I'm just being messed around. What do you think?

As far as I'm aware, sellers are not allowed to list items which cannot be shipped within 30 days, so the seller was in breach of the rules.

 

You have 30 days from the delivery estimate on the order in which to open an Item Not Received case on Ebay, so I imagine you're well out of time. Read the 30-day Money Back Guarantee for yourself so you're not caught out in future - it's on every listing, and in various other places across the site.

 

As such, you will have to open an INR case in PayPal (you have 180 days from purchase date). Do not close the case on a promise. As here, closed cases can't be reopened, and you won't be able to open another.

To be fair, there is comic delays for probably a few stors. I am waiting for some comics which some shops have had via shipment, and others I am still waiting to be filled. For example FP have split one of my order meant all have shipped by the 13th of Jan and I just received 4th part of it with a couple of items still to be filled from their pre-orders I presume.  I have confidence they will probably complete the last part of the order eventually, but not all companies are FP. I would advise probably to ask for a refund if you are not happy with the situation and gauge the sellers reputation. Going beyond 30 days makes it difficult to get a return with the e-bay 30 day protection, but if the seller has gave you replies in black and white on the reasons they have not shipped then they should A) be willing to give you a refund if you ask, and I would go down that route B) Ebay are normally pretty good beyond 30 days in circumstances where the seller and buyer have been talking, they will step in normally but the process normally means raising a case to the buyer to give final chance of fixing the problem C)  If A) and B) do not get your refund result, then possible Paypal next. 

Would like to think any reputable seller wouldnt think twice about giving a refund if asked given the time delay. OK they will be left with stock, but hopefully the comic is easily resold or a hot title etc.
