How does a 1972 poster fit in to this process?
It's not an exempt category.
Advise buyers this item is for viewing only ?
My initial reaction, sadly, to to switch EU and NI off.

I would love to keep selling in NI and EU but they are taking down and hiding listings even before the Dec 13th date. We can't relist the items as we have been told. We appeal the listing as not up for NI/EU and no one answers the appeal in 2 weeks...
We are entering our peak surge and the worry across every seller is apparent and not fair in any regard.

But....as they were made BEFORE this deadline, they would not be required to have added info? As they were sold BEFORE this compliance comes in?
Or am I missing something?

this is a point that I made but ebay says (very sleepy customer non service advisor) that the rules cover all goods regardless
honesty I am amazed at the lack of support for sellers by ebay on this one,

That's the case officially, and how ebay tell it on their own GPSR page (2 sections were recently added to the FAQ, both citing article 51) but they seem to have AI going around merrily contradicitng article 51 by demanding exempt listings be made compliant.
It makes ZERO sense.

The GPSR doesn’t apply to the UK, but it does apply to Northern Ireland.
There’s no exemption for products whose manufacturer no longer exists. However, according to Article 51 of the GPSR, products that were first supplied to the EU market before December 13, 2024, and comply with the General Product Safety Directive (2001/95/EG), can continue to be sold without adding GPSR-required information in listings.
Article 51 of the GPSR is also applicable if you sell second-hand products that were first supplied to the EU market before December 13, 2024, and comply with the General Product Safety Directive (2001/95/EG). For these products, you’re not required to provide GPSR-required information in your listings.

1 - They are all before the Dec date placed on the market. Even if we list them afterwards and manufacturers/importers placed them on the market beforehand - we don't apply to GPSR
2- if we remove NI/EU the listings should be 100% safe from GPSR applying.
*Ebay are hiding and taking down listings and have been even though no applicable laws yet apply.
* Even though we appeal based on applicable laws not applying the listings remain hidden.
*Even though eBay guidance states we are ok, still listings are getting hit.
*We frightingly seem to be holding our businesses here on the basis of assumption and that is a scary place to be, especially with peak around the corner.

Actually....if they ARE using AI to interpret rules, it does make a bit of sense. (The confusion, i mean. OBVIOUSLY, the contradictory information is mind melding and incredibly frustrating....)

If anyone is at the Open Day or virtually you can go into the Regulatory changes and how they effect your business session from 10:45 on the app and leave questions, it might help some users who are still none the wiser and are suffering because of it. Thankfully I only sell one brand.

Interesting. eBay obviously started with toys; lately they seemed to be moving onto low voltage (i.e. battery/DC powered) things and clothing. Low voltage would explain the earphones but not the other items.

it's a very confussing time and very stressful as ebay is my main selling page,
I have stressed the fact that I can not purchase stock with the high risk it will be taken down, I already now have stock I have purchased in the last 3 months removed by ebay due to GPSR , I have supplied the information I have that is upon the packaging but this has been rejected by ebay asking for safety files and further info,
I have asked ebay how I can run my business like this not knowing if and when my listings will be taken down ? how can I buy stock to sell , no advice given , just told thats just the way it is, so now looking for other avenues to explore.
I shall be closing down Christmas that I am very sad about , only started last year and invested a lot of time and money but the uncertainty is beyond stressful and very poor business practice 😞

If they are asking for the likes of SDS sheets, then the majority of them tend to be available online.
Just do a search for them. Though obviously it won't cover generic type items.
But to be fair, this is documentation that you should already have access to, if you are selling the kind of items that require it.

I have tried to get the information but a lot of my stock is discontinued lines so sometimes have been in a warehouse a few years before they come my way, I am finding a lot of the time website down or no reply to email requests , going round in circles

Connected to this issue but has anyone heard about GB type approval? It seems to be the Great Britain version of GPSR for NI & EU. I received a letter from the DVSA stating I need GB type approval for all my items for them to be legally sold here.
I sell aftermarket motorcycle parts. No one I buy from knew anything about it, not in China, Taiwan or Japan. The two large wholesalers in the UK, Hendler & Hi-Level, didn't seem to know anything about it either.
I've seen news about GPSR but no one has been talking about a GB equivilant. I've copied the following from the DVSA website.
To hold a GB Type Approval the approval holder will need to be based in Great Britain. If they are not, then a representative must be appointed who is.
A representative could be the approval holder or an additional third-party representative if the approval holder is not based in the required country. The obligations on the representative where they are a third-party are set out in Article 15 of EU regulation 2018/858 as retained in the UK.

The TSS service doesn't relate to GPSR.
It's for business to business sales.

Will eBay allow "private" sellers who continue to sell to NI without appointing a representative (and all the other requirements) to trade to NI ?
I cannot image a "private" seller when listing an item for sale in the UK inc NI , being required to complete the same related GPSR questions as a business seller ?

So as someone based in NI, this is a major pain, as buying from eBay is basically going to become impossible unless it comes from a private seller (who for some reason do not have to comply) and I have now a million almost impossible things to find out.
This EU policy was designed to have large businessess comply with safety regulations, the likes of TEMU, Ali etc. Why are eBay not challenging this on behalf of their sellers none of us are to the level of these companies?
I imagine sellers they have in the EU are not pleased as without completing all this information the only places they can sell to will have GSP costs

It is not when something was manufactured; it is when it was first made available on the EU market. The two are not the same thing.
In most cases eBay will have no idea when an item was first made available on the EU market. Even if the item was previously sold to a buyer in the EU via eBay then eBay almost certainly still needs to obtain evidence of compliance as the item was required to be compliant with Directive 2001/95/EC (an earlier version of the GPSRs) before the deadline. As per article 51:
"Member States shall not impede the making available on the market of products covered by Directive 2001/95/EC which are in conformity with that Directive and which were placed on the market before 13 December 2024."
Most goods that are not excluded from the GPSRs will have an EAN and any that require a CE mark will have a model number. I have no idea if eBay is recording product compliance against items in their catalog - it would seem daft of them not to - so that only one seller would need to provide compliance documentation for a given product. I'm pretty sure items offered for sale to the EU and NI are or will be (automatically) monitored by the EU's ICSMS; I have no idea if this is playing any role in eBay's current hiding/removal of listings for GPSR reasons.

It is the General Product Safety Regulations 2005 - the UK's implementation of the EU's earlier version of the GPSRs.
