Ebay forced refund without return

Hi,

 

My brother has recently sold 5 decals to one person who then claimed that they were too big (despite having size options available).  She then separately purchased the size she actually wanted and opened a return for the others.  No problem,  my brother issued her with a return label and ebay said that the return should be made by 21 February.

 

Today ebay messaged my brother to say that he had 4 days to sort the refund or they would step in.  The return label has not been used and the buyer has not uploaded her own tracking / label to the return portal.  No return goods have been received so MB  asked ebay to step in.  They immediately stated that the decals had been returned and that a refund must be issued.  RM tracking also confirms that they are still expecting the parcel but have not yet received it.

 

Is there any way to appeal ebay's decision given that he is now out of pocket AND minus the goods?

I have always read on these forums never ask eBay to step in as it is not looked at by a human

Apparently it is best to try first thing in the morning when you are more likely to get Ireland customer services.

If this was escalated to a case, then you should have the option of appealing it.

That would be the best route to go down first.
