Sold a gas hob Brand new

Hi all, hope someone can help me, I sold a neff gas hob burner all brand new in the box straight from the factory.

Now the buyer of one of the ones I sold has come back and said that after he has paid a gas engineer to fit the hob that they have noticed a mark on the black hob grate and is now asking me to buy a new one for them, I would just like to know where I stand with Ebay as if there was a mark they should have noticed prior to installing and also I take photos before shipping and can clearly see no marks. The item can not be returned as it has been opened and installed. Will Ebay understand that they should have checked prior to installing and also take my photos into account.

Clear enough feedback-blackmail, which is against eBay's rules. If buyer does leave bad feedback, contact eBay to get it removed. I believe eBay can be lax about some things but they're quite strict about that.

That isn't correct. Under the Consumer Rights Act a consumer has a short term right to reject goods; this can be exercised up to 30 days following delivery. After the short term right to reject has expired a consumer has a right to repair, replacement or a refund (if repair or replacement isn't possible) for faulty merchandise. This applies to all "durable" goods and any fault reported to the trader within 6 months of delivery is assumed to have been present on the day the item was received and no reduction can be made to the buyer's refund. After 6 months and up to the statute of limitations a consumer still has rights but the onus is on the consumer to prove the product was faulty when they received it and the trader can deduct an amount (up to the full amount) for the use their customer enjoyed of the product.

 

In your first post you mentioned the buyer wanted a replacement grate; there was no mention of a partial refund. Has your buyer sent any pictures of the alleged mark? It doesn't really matter now; you just need to resolve this whichever way will cost you the least. 

Give me ambiguity or give me something else.
