Re. VAT added to my listing on a resale item as a private seller used for personal use

@jiglo1

This is in response to your thread entitled 'VAT added to my listing on a resale item as a private seller used for personal use' as I am unable to respond directly to that thread.

'Is the VAT applied to all software sales from every seller, or is this something I can somehow do something about?'

In answer to your question, yes VAT applies to all digital sales regardless of whether you are a business or private seller.  If you are a Private Seller then ebay is responsible for collecting and remitting the VAT to HMRC:

'VAT on digital goods

From 28 April 2022, eBay will collect UK VAT from buyers of digital goods, and will remit that VAT directly to the UK tax authorities.

Digital goods (also known as eservices) are services which are provided electronically to buyers. Examples include the supply of software and the updating of software, the supply of images, text and information (such as ebooks), the supply of music, films and games online or by download.

A list of digital goods can be found at the HMRC site.

Note: If a buyer is a VAT registered business, eBay will not collect VAT and instead the seller retains responsibility.'

Thanks for your reply. It looks to need more clarity though relating to transfer of ownership as that information you supplied seems to suggest buying using an automated process and perhaps directly from a business.
