Listing Removed , but thousands of other sellers

Ok, i am new at this, but i have had a listing removed because it is a dangerous item .!!!
But there are thousands of the same item on ebay, to be honest that is why i placed it on ebay.
The item is a fidget pen.
Why is mine removed but others allowed to sell it
Please help a Newbie

Because someone would have reported your listing.

They have not reported the others.

Contact chat and ask if you can relist because of this. DON'T just relist without talking to ebay as you might find you have account restrictions.

I Appealed straight away, and was told they are dangerous, as little children might swallow the pieces.
And ebay wouldn't allow it.
i don't want to infringe on any rules, and sort of accept what they are saying, but surely Lego / Marbles / anything small could be dangerous.
But why my ad when thousands of others out there.
One rule for one, one for another.
And if it was reported, then surely just a way to get rid of your rivals, especially if you sell for far less than them

adding to the advice already given -

 

Another possible problem is that you are holding stocks of and selling brand new items, a private seller cannot do that and your buyers are paying unnecessary fees when they buy from you.

They can, but they wouldn't usually have multiple of new items, such as the swords you have listed.  A private seller is one who is just selling off their own personal items such as clothes from their wardrobe, bits from their loft/garage etc.

 

A Business seller is someone who buys or makes items to sell on.  They need to be registered as a business to meet the requirements of UK law.

Got a reply back from appeal.
And given the green light to relist.

Ok.
So i relisted the item, Magnetic Fidget pen.
And after 30 minutes it has been taken down again.
Even after appeal says its ok to list.

Don't relist it; that item is subject to a Government product recall.

eBay customer service reps likely don't see the full reason the listing was removed; especially if it was removed by the Office for Product Safety and Standards.

Give me ambiguity or give me something else.

So what about the other thousand sellers, selling the same item. Please clarify.
Oh and by the way. Amazon have not banned the sale, there are thousands on there too.

Most of the 145 sellers I found are business sellers who have specified the magnetic flux (the problem identified by the OPSS) in the item specifics as being less than that of the recalled item. As business sellers have their business name, address and contact details displayed on their listings the OPSS can contact them directly if their products are suspect.

 

Besides, just because someone else gets away with doing something doesn't mean you should. If you saw someone walk out of a shop without paying would you then feel entitled to do the same thing?

As above, items available on Amazon are either sold directly by Amazon or by marketplace sellers (i.e. businesses). It should also be noted that eBay, Amazon and other online marketplaces are well known to be woefully bad at policing the sale of dangerous items via their platforms; that's why the OPSS were given powers to remove dangerous listings themselves without needing to get the marketplaces involved. The OPSS is never going to keep up with the sheer numbers they have to deal with - I can easily find dangerous and illegal goods for sale on most of the UK's online marketplaces.

Although I disagree that most are business sellers, i will accept your decision and not relist them.
But I had already been given the all clear to do so.

I always check first on ebay if i have anything that shouldnt be listed, and if i find the same items i should be certain it is ok. But obviously not.

I have a set of kitchen knives that I am uncertain about, what is the ruling on that please.?

Again I thank you for your time, and again stress that i only relisted them because your colleague said i could.

You might want to read eBay's knives policy.

 

Just to illustrate how product safety is a secondary consideration where online marketplaces are concerned this is a listing picture from one of the business sellers with a version of that pen for sale. Bear in mind this item contains many small parts - including small colourful pieces and magnetised ball bearings - making it wholly unsuitable for a young child or toddler:
